HomeMy WebLinkAbout047 - 05/06/1986 - VACATING PORTIONS OF THE BLANKET EASEMENT LOCATED IN TRACTS A, D, AND E OF CIMARRON PLAZA PUD REPLAT ORDINANCE NO. 47 , 1986 OF THE COUNCIL OF THE CITY OF FORT COLLINS VACATING PORTIONS OF THE BLANKET EASEMENT LOCATED IN TRACTS A, D, AND E OF CIMARRON PLAZA PUD REPLAT WHEREAS, the Council of the City of Fort Collins has been petitioned to vacate portions of the blanket easement located in Tracts A, D, and E of Cimarron Plaza PUD Replat, set forth in more particular below; and WHEREAS, revisions to the final site plan of Cimarron Plaza PUD have changed building locations creating encroachments into the blanket utility, access and drainage easement; and WHEREAS, replacement easements have been dedicated to the City by the Developer of Cimarron Plaza PUD; and WHEREAS, there are no utilities presently located in the easements to be vacated; and WHEREAS, all utilities have been contacted and have indicated no problems with the vacation; and WHEREAS, the rights of the residents of the City of Fort Collins will in no way be prejudiced or injured by said vacation. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT COLLINS that those certain portions of a blanket utility easement located in Tracts A, D, and E of Cimarron Plaza PUD, set out more particularly as follows, to wit: PARCEL A A parcel of land being a part of Cimarron Plaza P.U.D. Replat located in the Northeast Quarter of Section 27, Township 7 North, Range 69 West of the 6th P.M. , City of Fort Collins, County of Larimer, State of Colorado, being more particularly described as follows: Considering the East line of the Northeast Quarter of said Section 27 as bearing S 00°04' 51" West, from a "pk" nail at the Northeast corner to a found No. 5 rebar at the East Quarter corner of said Section 27 and with all bearings contained herein relative thereto. Commencing at the Northwest corner of said Cimarron Plaza P.U.D. Replat; thence along the West line of said Cimarron Plaza P.U.D. Replat, South 00004' 51" West, 146.00 feet; thence, South 89°55'09" East, 15.00 feet to the Point of Beginning; said Point of Beginning being on the West line of the Northwesterly building envelope as shown on the plat of said Cimarron Plaza P.U.D. Replat; thence, South 89°55'09" East , 89.00 feet to the Easterly line of said building envelope; thence along the Easterly, Southerly and Westerly line of said building envelope, South 00°04' 51" West, 11.00 feet; thence, North 89°55'09" West, 89.00 feet; thence, North 00°04' 51" East, 11.00 feet to the Point of Beginning. The above described parcel contains 979 square feet. PARCEL D A parcel of land being a part of Cimarron Plaza P.U.D. Replat located in the Northeast Quarter of Section 27, Township 7 North, Range 69 West of the 6th P.M. , City of Fort Collins , County of Larimer, State of Colorado, being more particularly described as follows: Considering the East line of the Northeast Quarter of said Section 27 as bearing South 00°04' 51" West from a found "pk" nail at the Northeast corner to a found No. 5 rebar at the East Quarter corner of said Section 27 and with all bearings contained herein relative thereto: Commencing at the Northwest corner of said Cimarron Plaza P.U.D. Replat; thence along the West line of said Cimarron Plaza P.U.D. Replat, South 00°04'51" West, 166.00 feet; thence, South 89°55'09" East, 95.00 feet to a point on the East line of the Southwesterly building envelope as shown on the said plat of Cimarron Plaza P.U.D. Replat; thence along said East line, South 00004' 51" West, 103.93 feet to the Point of Beginning; thence, South 00004' 51" West, 11.51 feet; thence, South 44°55'09" East, 61.60 feet; thence, South 89°55'08" East, 11.51 feet; thence, North 44°55'09" West, 77.88 feet to the Point of Beginning. The above described parcel of land contains 568 square feet. PARCEL E A parcel of land being a part of Cimarron Plaza P.U.D. Replat located in the Northeast Quarter of Section 27, Township 7 North, Range 69 West of the 6th P.M. , City of Fort Collins, County of Larimer, State of Colorado, being more particularly described as follows: Considering the East line of the Northeast Quarter of said Section 27 as bearing South 00°04' 51" West from a found "pk" nail at the Northeast corner to a found No. 5 rebar at the East Quarter corner of said Section 27 and with all bearings contained herein relative thereto: Commencing at the Northwest corner of said Cimarron Plaza P.U.D. Replat; thence along the West line of said Cimarron Plaza P.U.D. -2- Replat, South 00004' 51" West, 350.00 feet; thence South 42°00'00" East, 108.59 feet; thence, South 89026'57" East, 11.23 feet; thence North 00°04' 51" East, 15.69 feet to the Point of Beginning, said Point of Beginning being on the South line of the Southwest building envelope as shown on the plat of Cimarron Plaza P.U.D. Replat; thence, North 89°55'09" West, 3.22 feet; thence, North 44055'09" West, 93.03 feet; thence, North 00°04' 51" East, 3.22 feet; thence, South 44055' 09" East, 97.58 feet to the Point of Beginning. The above described parcel of land contains 217 square feet. be, and the same hereby are, vacated, abated and abolished. Introduced, considered favorably on first reading and ordered published this 15th day of April , A.D. 1986, and to be presented for final passage on the 6th day of May, A.D. 1986.
