HomeMy WebLinkAbout035 - 03/18/1986 - AMENDING CITY CODE TO INCLUDE CERTAIN WINTER QUARTER BASED NON-RESIDENTIAL SEWER USERS IN THE CATEGO ORDINANCE NO. 35 , 1986 - OF THE COUNCIL OF THE CITY OF FORT COLLINS AMENDING SECTIONS 112-69(B) (3) AND (4) OF THE CODE OF THE CITY TO INCLUDE CERTAIN WINTER QUARTER BASED NON-RESIDENTIAL SEWER USERS IN THE "CATEGORY C" CLASSIFICATION OF USERS WHEREAS, there may exist certain non-residential sewer users (such as churches and offices) in the City of Fort Collins for which the classification of "Category D/minor non-residential user" is inappropriate for the purpose of determination of sewage charges for such users; and WHEREAS, such low-impact non-residential users may, in certain instances, consume proportionately greater amounts of potable water for irrigation purposes, which waters are not discharged into the sanitary sewage system; and WHEREAS, the Council of the City of Fort Collins has determined that it is in the best interest of the City that the Code be amended to provide a mechanism whereby such low impact non-residential sewer users may be classified as "Category C" users and billed for sanitary sewage services based upon winter quarter water use. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT COLLINS that: Section 1 . That Section 112-69(B) (3) of the Code of the City of Fort Collins be repealed and reenacted as follows: (3) Category C: multiple-family residential user [more than two (2) living units] ; AND WINTER QUARTER BASED NON-RESIDENTIAL USER. A WINTER QUARTER BASED NON-RESIDENTIAL USER IS A USER WHO DISCHARGES ONLY WASTES OF A TYPE AND STRENGTH NORMALLY DISCHARGED BY PRIVATE RESIDENCES, AND WHO DISCHARGES ONLY WASTES REASONABLY AND REGULARLY CORRESPONDING TO THE WINTER QUARTER WATER USE. Section 2. That Section 112-69(B) (4) of the Code of the City of Fort Collins be repealed and reenacted as follows: (4) Category D: minor non-residential user. A minor non-residential user is a user who discharged only wastes of a type and strength normally discharged by private residences. All non-residential users not subject to the provisions of Categories C, E and F shall be classed as minor non-residential users, Category D.
