OF THE COUNCIL OF THE CITY OF FORT COLLINS
VACATING TWO FEET OF A UTILITY EASEMENT
LOCATED AT 800 LEMAY
WHEREAS, the Council of the City of Fort Collins has been petitioned
to vacate the east two feet of a utility easement located at 800 Lemay set
forth in more particular below; and
WHEREAS, the plat of the property contains an error in the description
of the centerline of Lemay and the true section line; and
WHEREAS, the proposed building and parking area to be located at 800
Lemay will protrude 1 .61 feet into the existing utility easement if part of
that easement is not vacated to compensate for said error; and
WHEREAS, all utility companies have been contacted and expressed no
objections to the vacation; and
WHEREAS, the rights of the residents of the City of Fort Collins will
in no way be prejudiced or injured by said vacation.
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT
COLLINS that a portion of a utility easement located at 800 Lemay described
more particularly as follows, to wit:
Commencing at the West quarter corner of said Section 18; thence
along the centerline of Lemay Avenue, North 00°00'00" East 899.94
feet; thence South 90000'00" East 60.00 feet to the true point of
beginning of this description, thence along North 00°00'00" East
line, South 71 .00 feet; thence along South 90°00'00" East line,
East 2.0 feet; thence along North 00°00'00" East line, North
71.00 feet; thence along South 900001001, line, West 2.0 feet to
the true point of beginning.
Containing 142 square feet or 0.003 acres.
be, and the same hereby is, vacated, abated and abolished.
Introduced, considered favorably on first reading and ordered
published this 18th day of November, A.D. 1986, and to be presented for
final passage on the 4th day of December, A.D. 1986.
