HomeMy WebLinkAbout111 - 07/21/1987 - VACATING UTILITY EASEMENTS IN SOUTHMOOR VILLAGE FIRST AND THIRD FILINGS ORDINANCE NO. 111 , 1987 OF THE COUNCIL OF THE CITY OF FORT COLLINS VACATING PORTIONS OF UTILITY EASEMENTS IN IN SOUTHMOOR VILLAGE FIRST AND THIRD FILINGS WHEREAS, the Council of the City of Fort Collins has been petitioned by Richard J. Vesely, owner of Lot 66 and a portion of Lot 135 in Southmoor Village First and Third Filings respectively, to vacate 6 feet and 2 feet respectively of two existing utility easements described more particularly below; and WHEREAS, the owner acquired a portion of Lot 135 from an adjacent property owner and wishes to build an addition to the existing house on the combined property; and WHEREAS, in order to accomplish this, the owner is requesting that the southern 6 feet of the utility easement of said Lot 66 and the northernmost 2 feet of the utility easement of said Lot 135 be vacated; and WHEREAS, no underground utilities exist in the portion proposed to be vacated, and the remaining 4 foot easement will provide adequate utility access for said Lots and adjacent lots; and WHEREAS, City agencies and Utility companies have been contacted and report no problems with the vacation; and WHEREAS, there will be no cost to the City in vacating said easements; and WHEREAS, the rights of the residents of the City of Fort Collins will in no way be prejudiced or injured by said vacation. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT COLLINS that the utility easements dedicated on the plats of Southmoor Village First Filing, and Southmoor Village Third Filing, recorded with the Larimer County Clerk and Recorder described more particularly as follows, to wit: A tract of land located in the NE 1/4 of Section 25, T 7 N, R 69 W of the 6th P.M. , City of Fort Collins, Larimer County, Colorado, more particularly described as follows: The entire 6 foot utility easement at the Southern boundary of Lot 66, Southmoor Village, First Filing according to the plat recorded in Book 1445, Page 207, of the Larimer County records, said easement extends from the Easternmost Right-of-Way line of Southmoor Drive to, but does not include, the 6 foot utility easement on the Eastern boundary of said Lot 66; and the Northernmost 2 feet of the 6 foot utility easement at the Northern boundary of Lot 135, Southmoor Village, Third Filing according to the plat recorded in Book 1766, Page 143 of the Larimer County records, said easement extends from the East line of the existing 6 foot utility easement on the Western Boundary of said Lot 135 to the extension of the West line of the 6 foot utility easement on the Eastern boundary of Lot 66, Southmoor Village, First Filing. be, and the same hereby are vacated, abated and abolished. Introduced, considered favorably on first reading and ordered published this 7th day of July, A.D. 1987 and to be presented for final passage on the 21st day of July, A.D. 1987.
