OF THE COUNCIL OF THE CITY OF FORT COLLINS
VACATING A UTILITY EASEMENT AT
OVERLAND TRAIL FARM SUBDIVISION
WHEREAS, the Council of the City of Fort Collins has been petitioned
by the owner of Overland Trail Farm Subdivision to vacate an existing 20
foot utility easement described more particularly below; and
WHEREAS, the owner, American Diversified Saving Bank has replatted the
tract of land containing said easement proposed to be vacated, and the
Planning and Zoning Board approved the replat on October 27, 1986; and
WHEREAS, the replat includes the dedication of adequate utility
easements to construct all required utilities; and
WHEREAS, City agencies and Utility companies have been contacted and
report no problems with the vacation; and
WHEREAS, there will be no cost to the City in vacating said easement;
and
WHEREAS, the rights of the residents of the City of Fort Collins will
in no way be prejudiced or injured by said vacation; and
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT
COLLINS that the utility easement dedicated on the plat of Overland Trail
Farm Subdivision, recorded with the Larimer County Clerk and Recorder and
described more particularly as follows, to wit:
An easement twenty (20) feet wide; being ten (10) feet each side
of the following described centerline:
Beginning at a point on the East line of the Northwest 1/4 of the
Southwest 1/4 of Section 16, Township 7 North, Range 69 West of
the 6th P.M. ; City of Fort Collins, County of Larimer, State of
Colorado, which bears S 00010' E 470.48 feet, and again S 80*02'
E 877.65 feet, and again S 00010' E 234.03 feet, and again S
89°33'30" E 429.91 feet, and again S 00°04'20" E 140.00 feet from
the West 1/4 corner of said Section 16, and run thence N
89°33'30" W 285.00 feet; thence S 84*40' W 245.00 feet; thence N
23*22' W 230.00 feet; thence N 45*00' E 266.00 feet.
be, and the same hereby is vacated, abated and abolished.
Introduced, considered favorably on first reading and ordered
published this 7th day of July, A.D. 1987 and to be presented for final
passage on the 21st day of July, A.D. 1987.
