HomeMy WebLinkAbout109 - 07/21/1987 - VACATING ALL STREET RIGHTS-OF-WAY AND EASEMENTS AT FAIRWAY FIVE AT SOUTHRIDGE GREENS PUD ORDINANCE NO. 109, 1987 OF THE COUNCIL OF THE CITY OF FORT COLLINS VACATING ALL STREET RIGHTS-OF-WAY AND EASEMENTS AT FAIRWAY FIVE AT SOUTHRIDGE GREENS P.U.D. WHEREAS, the Council of the City of Fort Collins has been petitioned by the Developer of Fairway Five Estates P.U.D at Southridge Greens to vacate existing street rights-of-way and easements platted with the Fairway Five at Southridge Greens P.U.D. plat set forth more particularly below; and WHEREAS, the Developer, Albrecht Companies Inc. , replatted the entire tract of land previously known as Fairway Five at Southridge Greens P.U.D. which was replatted as Fairway Five Estates P.U.D. at Southridge Greens, and the Planning and Zoning Board approved the replat on May 18th, 1987; and WHEREAS, the replat provides adequate right-of-way and easement dedication to construct streets and install utilities which meet City approved standards; and WHEREAS, City agencies and Utility companies have been contacted and report no problems with the vacation; and WHEREAS, there will be no costs to the City in making the proposed change in public right-of-way; and WHEREAS, the rights of the residents of the City of Fort Collins will in no way be prejudiced or injured by said vacation; and NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT COLLINS that the rights-of-way and easements located on the plat of Fairway Five at Southridge Greens P.U.D. , recorded with the Larimer County Clerk and Recorder described more particularly as follows, to wit: All streets and easements in "Fairway Five at Southridge Greens PUD" to the City of Fort Collins, Colorado in Section 6, Township 6 North, Range 68 West of the 6th Principal Meridian, except that portion of "Front Nine Drive" lying South of the following described line. Beginning at the Southeast Corner of "Fairway Five at Southridge Greens PUD" thence along the Southerly line of said PUD North 67°48'30" West 154.63 feet and again North 56°24'21" West 53.05 feet to the Easterly right of way of Front Nine Drive and the True Point of Beginning of said line, thence North 56024"21" West 40.89 feet to the Westerly Right of Way of said Drive and the terminus of said line. be, and the same hereby is vacated, abated and abolished. Introduced, considered favorably on first reading, and ordered published this 7th day of July, A.D. 1987 and to be presented for final passage on the 21st day of July, A.D. 1987.
