OF THE COUNCIL OF THE CITY OF FORT COLLINS
ANNEXING PROPERTY KNOWN AS THE
RIVERBEND SECOND ANNEXATION
TO THE CITY OF FORT COLLINS, COLORADO
WHEREAS, Article II, Section 30 of the Constitution of the State of
Colorado requires that one of the following conditions be met before an
unincorporated area be annexed to a municipality:
I . The question of annexation be submitted to a vote of the
landowners and registered electors of the area to be annexed
and the majority of such persons voting, vote in favor of
annexation; or
2. The annexing municipality receive a petition for annexation
signed by more than 50% of the landowners in the area who
own more than 50% of the land; or
3. The area to be annexed be entirely surrounded by or be
solely owned by the annexing municipality; and
WHEREAS, 100% of the landowners in the Riverbend Second Annexation
area have signed a petition for annexation; and
WHEREAS, not less than one-sixth (1/6th) of the perimeter of the area
to be annexed is contiguous with the City of Fort Collins and a community
of interest exists between the territory to be annexed and the City of Fort
Collins; and the territory to be annexed is urban or will be urbanized in
the near future; and such territory is integrated or is capable of being
integrated with the City of Fort Collins; and
WHEREAS, no election is required and no additional terms and
conditions are to be imposed in connection with this annexation; and
WHEREAS, the Council has found and determined and does hereby find and
determine that said petition is in substantial compliance with the
annexation laws of the State of Colorado and that the territory is eligible
for annexation, and the City Council desires to annex the same to the City
of Fort Collins; and
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT
COLLINS:
Section 1. That the following described property be, and hereby is,
annexed to the City of Fort Collins and made a part of said City, to be
known as the Riverbend Second Annexation.
A tract of land situate in Section 17, Township 7 North, Range 68
West of the 6th P.M. , Larimer County, Colorado, and considering
the west line of the SE 1/4 of said Section 17 as bearing N 000
08' 30" W and with all bear ings contained herein relative
thereto, begins at a point which bears N 00° 08' 30" W - 850.00
feet from the south 1/4 corner of said Section 17, said point
being on the boundary of Suitts First Annexation to the City of
Fort Collins. -Thence along said annexation N 000 08' 30" W -
1289.39 feet, thence S 670 29' 00" W 372.81 feet, thence N 67°
47' 00" W - 243.70 feet, thence N 350 43' 00" W - 354.70 feet,
thence N 140 07' 00" E - 223.00 feet, thence N 150 46' 00" W -
190.20 feet, N 350 52' 00" E - 140.20 feet, thence N 890 05' 00"
W - 156.60 feet, thence N 260 00' 00" W - 148.00 feet, thence N
61° 31' 00" W - 186.90 feet, thence N 460 35' 00" W - 187.50
feet, thence N 470 38' 00" W - 60.00 feet, thence N 36° 18' 00" W
221.20 feet, thence N 390 30' 00" W - 129.71 feet, to a point on
the Suitts Second Annexation to the City of Fort Collins, thence
along said annexation, N 39° 30' 00" W - 95.29 feet, thence N 19°
06' 00" W - 173.00 feet to a point on the River bend Annexation
to the City of Fort Collins, thence along said annexation, N 81°
12' 08" E - 710.11 feet, thence leaving said annexation and
following a line which becomes the southerly boundary of
Countryside Park - Phases Two and III, subdivisions of Larimer
County, Colorado, thence along said subdivisions S 88° 48' 46" E
- 740.76 feet, thence along a 211 .14 foot radius curve to the
right a distance of 168.29 feet, the long chord of which bears S
650 58' 46" E - 163.87 feet, thence S 430 08' 46" E 177.55 feet,
thence S 13° 14' 49" E - 350.00 feet, thence S 75° 36' 16" E -
590.80 feet, thence N 11° 40' 46" W - 11.77 feet, thence S 870
54' 16" E -121. 40 feet, thence S 80° 29' 58" E - 750.00 feet,
thence leaving said subdivision boundary S 350 29' 58" E - 746.63

bears N 000 28' 13" W - 1200.00 feet from the southeast corner of
said Section 17, thence S 890 59' 13" W - 1054.08 feet, thence S
020 00' 06" W - 176.80 feet, thence S 830 05' 05" W - 1188.58
feet, thence S 89° 51' 30" W -395.31 feet to the point of
beginning.
Containing 164.8397 acres more or less.
Section 2. That in annexing said territory to the City of Fort
Collins, the City of Fort Collins does not assume any obligation respecting
the construction of water mains, sewer lines, gas mains, electric service
lines, streets or any other services or utilities in connection with the
territory hereby annexed except as may be provided by the ordinances of the
City of Fort Collins.
Section 3. That no building permit shall be issued for any of the
lands herein described unless said lands have been zoned under the zoning
ordinances of the City.
Introduced, considered favorably on first reading, and ordered
published this 21st day of October, A.D. 1986, and to be presented for
final passage on the 4th day of November, A.D. 1986.
