OF THE COUNCIL OF THE CITY OF FORT COLLINS
AUTHORIZING THE CITY MANAGER TO ENTER INTO A
WATER EXCHANGE AGREEMENT
WHEREAS, the City Council has been presented, and has examined a
certain Exchange Agreement with effective date of June 17, 1986, between
the City and the Water Supply and Storage Company (which agreement shall
hereinafter be referred to as the "Exchange Agreement") ; and
WHEREAS, upon examination and consideration of the Exchange Agreement,
the Council does hereby determine that the exchange as proposed in said
agreement, of a part of the Water Utility System, does not materially
impair the viability of the particular utility system as a whole; and
WHEREAS, the Council does further determine that the execution of the
Exchange Agreement by the City is for the benefit of the citizens of the
City of Fort Collins; and
WHEREAS, the Council does determine that there exists an emergency
affecting the public peace, health, safety and property of the City, more
particularly: (1) the City owns stock in various irrigation and reservoir
companies which are not particularly useful to the City in its present
water system, and (2) the Water Supply and Storage Company has offered to
exchange shares of stock in its company for other shares of water owned by
the City and other reservoir and ditch companies and (3) the opportunity
for the exchange of water shares as presented by the Water Supply and
Storage Company must be acted upon at once so that the City may avail
itself of the opportunity presented for the exchange of water as set out in
the proposed Exchange Agreement; and this Ordinance is therefore enacted
pursuant to Article II, Section 6, of the Charter of the City of Fort
Collins as an emergency Ordinance and shall be effective immediately upon
its passage.
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT
COLLINS that, in consideration of the premises, and the recitals of fact as
hereinbefore stated, the City Manager be, and he hereby is, authorized to
execute on behalf of the City the Exchange Agreement between the City and
the Water Supply and Storage Company.
Introduced, considered favorably by 5 members of the Council of the
City of Fort Collins and finally passed as an emergency ordinance and
ordered published this 17th day of June, A.D. 1986.
