OF THE COUNCIL OF THE CITY OF FORT COLLINS
VACATING A UTILITY EASEMENT IN ROSSBOROUGH, THIRD FILING
WHEREAS, the Council of the City of Fort Collins has been petitioned
to vacate a utility easement located between Lots 137 and 138 on Chelsea
Court in Rossborough, Third Filing, set forth more particularly below; and
WHEREAS, the easement was originally dedicated for a proposed sewer
line connecting Rossborough, Second Filing with Rossborough, Third Filing;
and
WHEREAS, the proposed sewer line was actually placed in Tract "D" of
Rossborough, Third Filing; and
WHEREAS, the original easement in no longer needed as all utilities
for this portion of Rossborough have been completed and there are no
utility lines in the easement to be vacated; and
WHEREAS, all utility companies have been contacted and indicate no
problems with the vacation; and
WHEREAS, the rights of the residents of the City of Fort Collins will
in no way be prejudiced or injured by said vacation.
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT
COLLINS that that certain utility easement located between Lots 137 and
138, Rossborough, Third Filing, set out more particularly as follows, to
wit:
A twenty foot wide utility easement situate in Lots 137 and 138,
Rossborough, Third Filing, City of Fort Collins, County of
Larimer, State of Colorado which begins at a point on the line
common to said Lots 137 and 138 which bears S 20*11' E 10. 16 feet
from the most Northerly corner of said Lot 137 and run thence N
59°29' E 10. 16 feet; thence S 20*11' E 88.28 feet; thence along
the arc of a 58.00 foot radius curve to the left a distance of
20.10 feet, the long chord of which bears S 69°49'08" W 20.00
feet; thence N 20*11' W 84.63 feet; thence N 59*29' E 10.16 feet
to the point of beginning.
be, and the same hereby is, vacated, abated and abolished.
Introduced, considered favorably on first reading and ordered
published this 3rd day of June, A.D. 1986, and to be presented for final
passage on the 17thday of June A.D. 1986.
