OF THE COUNCIL OF THE CITY OF FORT COLLINS
AMENDING CERTAIN PROVISIONS OF THE CODE OF THE CITY
OF FORT COLLINS REGARDING LITTERING AND THE
DISTRIBUTION OF HANDBILLS
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT COLLINS that the
Code of the City of Fort Collins be, and the same hereby is, amended as
follows:
Section 1. Article X of Chapter 73, "Distribution of Handbills, " is
hereby repealed in its entirety.
Section 2. Section 84-3B, "Littering, " is repealed and readopted as
follows:
B. Littering.
No person shall throw, deposit, scatter or leave upon
any sidewalk, alley, street or other public place in
the City or on any private property in the City any
loose paper, rags, rubbish, waste material , refuse,
garbage, trash, debris, or other foreign substances,
nor shall any person owning or occupying any lot or
ground in the City allow or permit any such material
which may be liable to be blown or scattered by the
wind or otherwise to remain upon such lot or grounds.
For the purposes of this section, the distribution of
advertising circulars or handbills in such a manner so
that they are securely placed or deposited upon real
property so as to prevent the same from being blown or
scattered by the wind does not constitute littering.
Introduced, considered favorably on first reading and ordered
published this 6th day of May, A.D. 1986, and to be presented for final
passage on the 20th day of May, A.D. 1986.
