OF THE COUNCIL OF THE CITY OF FORT COLLINS
VACATING A PORTION OF THE RIGHT-OF-WAY
IN TRACT "B" OF SILVERPLUME ESTATES
WHEREAS, the Council of the City of Fort Collins has been requested to
vacate a portion of the right-of-way in Tract "B" of Silverplume Estates,
set forth in more particular below; and
WHEREAS, the right-of-way was originally dedicated for use as an open
storm drainage channel , which use is no longer necessary as the alignment
of the downstream end of the channel does not require the entire area in
Tract "B"; and
WHEREAS, an additional easement is required to implement the storm
drainage open channel ; and
WHEREAS, the owner of the adjacent lot has agreed to dedicate this
easement for the open channel if the City will vacate the area in Tract "B"
no longer needed; and
WHEREAS, all utility companies have been contacted and indicate no
problems with the vacation; and
WHEREAS, the rights of the residents of the City of Fort Collins will
in no way be prejudiced or injured by said vacation.
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT
COLLINS that a portion of the right-of-way located in Tract "B" of
Silverplume Estates, set out more particularly as follows, to wit: A part
of Tract B, Silverplume Estates, City of Fort Collins, County of Larimer,
State of Colorado, being more particularly described as follows:
Begin at a point on the East line of said Tract B, which bears N
00000'29" W 15.00 feet from the Southeast corner of said Tract B
and runs thence along said East line N 00°00'29" W 35.24 feet;
thence along the arc of a 100 foot radius curve to the left a
distance of 83. 13 feet, the long chord of which bears N 23049' 19"
W 80.75 feet; thence along the arc of a 70 foot radius curve to
the left a distance of 4. 19 feet, the long chord of which bears S
28017139" E 4.19 feet; thence S 30°00'29" E 46.41 feet; thence
along the arc of a nontangent curve with a radius of 290.66 feet,
a distance of 65.80 feet the long chord of which bears S 06°29'36"
E 65.66 feet to the point of beginning, containing 299 square
feet, more or less.
be, and the same hereby is, vacated, abated and abolished.
Introduced, considered favorably on first reading, and ordered
published this 19th day of August, A.D. 1986, and to be presented for final
passage on the 2nd day of September, A.D. 1986.
