OF THE COUNCIL OF THE CITY OF FORT COLLINS
AMENDING SECTION 73-129 OF THE CODE OF THE CITY OF FORT COLLINS
REGARDING GUARANTEE OF SIDEWALKS, DRIVEWAYS,
CURBS AND GUTTERS
WHEREAS, Section 73-129 of the Code of the City of Fort Collins
requires a two-year guarantee of materials and workmanship for the
construction of sidewalks, driveways, curbs and gutters; and
WHEREAS, in 1981 the City Council passed Resolution 81-130 which
adopted the manual Design Criteria and Standards for Streets to be used
throughout the City of Fort Collins; and
WHEREAS, said manual provides for a one-year guarantee for the same
work referred to in Section 73-129 of the Code; and
WHEREAS, this conflict has been discussed by City staff and members of
the private sector who were charged with reviewing the 1981 Design Criteria
and Standards for Streets and it is their recommendation that the Code be
amended to conform to the one-year guarantee as provided in the Standards;
and
WHEREAS, said amendment would not prejudice or injure the rights of
the residents of the City of Fort Collins.
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT
COLLINS that Section 73-129(A) of the Code of the City of Fort Collins be
repealed and reenacted as follows:
§73-129. Guaranty of work.
A. All persons who may be duly licensed to construct concrete
sidewalks, driveways, curbs or gutters shall be required to
expressly guarantee the concrete sidewalks, driveways, curbs or
gutters for the period of one (1) year from and after its
completion and acceptance by the City Engineer, and be required
to maintain and make all necessary repairs on the same during
the period above named without additional charge or cost to the
property owner or the City of Fort Collins.
Introduced, considered favorably on first reading, and ordered
published this 15th day of July, A.D. 1986, and to be presented for final
passage on the 5th day of August, A.D. 1986.
