OF THE COUNCIL OF THE CITY OF FORT COLLINS
VACATING A UTILITY EASEMENT IN RAINTREE P.U.D.
WHEREAS, the Council of the City of Fort Collins has been petitioned
to vacate a utility easement located along the south property line of
Raintree P.U.D. set forth in more particular below; and
WHEREAS, a portion of Raintree P.U.D. was replatted as Raintree
Commercial P.U.D. which replat locates a building on the utility easement
proposed to be vacated; and
WHEREAS, all utilities have been contacted and indicate no problem
with the vacation; and
WHEREAS, the rights of the residents of the City of Fort Collins will
in no way be prejudiced by said vacation.
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT
COLLINS that that certain utility easement located in the Raintree P.U.D. ,
set out more particularly as follows, to wit:
The ten foot (10' ) utility easement along the South line of Tract
"J" of Raintree, a Planned Unit Development to the City of Fort
Collins, Larimer County, Colorado.
be, and the same hereby is, vacated, abated and abolished.
Introduced, considered favorably on first reading, and ordered
published this ZOth day of August, A.D. 1985, and to be presented for final
passage on the 3rd day of September, A.D. 1985.
