OF THE COUNCIL OF THE CITY—OF FORT COLLINS
VACATING A PORTION OF A UTILITY AND DRAINAGE EASEMENT
IN TRACT E OF FAIRBROOKE SID
WHEREAS, the Council of the City of Fort Collins has been petitioned
to vacate a portion of a utility and drainage easement located in Tract E
of Fairbrooke SID set forth in more particular below; and
WHEREAS, the development of Tract E is such that a twenty-five foot
(25' ) easement is no longer necessary and therefore it has been requested
that the easement be reduced to eight feet (8 ' ); and
WHEREAS, all utilities have been contacted and indicate no problem
with the vacation; and
WHEREAS, the rights of the residents of the City of Fort Collins will
in no way be prejudiced or injured by said vacation.
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT
COLLINS that that certain portion of a utility and drainage easement
located in Tract E of Fairbrooke SID, set out more particularly as follows,
to wit:
The South 17 .00 feet of the 25 .00 foot utility and drainage
easement lying adjacent to and South of Cedarwood Drive as shown
on Tract E . Fairbrooke S . I .D. to the City of Fort Collins ,
Colorado, and as recorded on Surveyors Affidavit of Correction,
Book 2304, Page 1646 , Records of Larimer County, Colorado
be, and the same hereby is, vacated, abated and abolished.
Introduced, considered favorably on first reading and ordered pub-
lished this 19th day of March, A.D. 1985, and to be presented for final
passage on the Ind day of April A.D. 1985.
