HomeMy WebLinkAbout2023-076-08/15/2023-REFERRING TO THE REGISTERED ELECTORS OF THE CITY OF FORT COLLINS RESOLUTION 2023-075, CONCERNING AME 1 NO ACTION TAKEN August 15, 2023 RESOLUTION 2023-076 OF THE COUNCIL OF THE CITY OF FORT COLLINS REFERRING TO THE REGISTERED ELECTORS OF THE CITY OF FORT COLLINS RESOLUTION 2023-075, CONCERNING AMENDING THE FORT COLLINS LAND USE CODE TO INCREASE OCCUPANCY ALLOWED IN RESIDENTIAL DWELLINGS OPTION 1 WHEREAS, the City Council passed and adopted Resolution 2023-075, directing City Staff to prepare amendments to the Land Use Code to increase the limits on occupancy to no more than ___ adults per dwelling unit and to eliminate familial relatedness as a mechanism for regulating occupancy, and present them to the City Council for consideration no later than [DATE]; and OPTION 2 WHEREAS, the City Council passed and adopted Resolution 2023-075, directing City Staff to prepare amendments to the Land Use Code to eliminate familial relatedness as a mechanism for regulating occupancy and to develop new regulations that increase the maximum occupancy allowed in residential dwellings based on the number of adults per dwelling unit, or based on building size or number of sleeping rooms (bedrooms), or by some other method, and present them to Council for consideration no later than [DATE]; and WHEREAS, Article X, Section 3 of the Charter of the City of Fort Collins authorizes the City Council to refer any adopted ordinance or resolution to the vote of the people at a regular election; and WHEREAS, accordingly, the City Council desires to refer to the Fort Collins electors Resolution 2023-075 which directs City staff to draft amendments to the Land Use Code as stated below. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT COLLINS as follows: Section 1. That the City Council hereby makes and adopts the determinations and findings contained in the recitals set forth above. Section 2. That the following ballot question, with its title and submission clause, is hereby adopted for referring Resolution 2023-075, concerning amending the Fort Collins Land Use Code to increase the limits on occupancy in residential dwellings, to the voters at the November 2023 Election: CITY-REFERRED RESOLUTION 2023-075 (Occupancy Limits) OPTION 1 Shall Resolution 2023-075, directing City Staff to prepare amendments to the Land Use Code to increase the occupancy allowed to no more than ___ adults per dwelling 2 NO ACTION TAKEN August 15, 2023 unit and to eliminate familial relatedness as a mechanism for regulating occupancy, and present them to the City Council for consideration no later than [DATE], be approved? ______Yes/For ______No/Against OPTION 2 Shall Resolution 2023-075, directing City Staff to prepare amendments to the Land Use Code to eliminate familial relatedness as a mechanism for regulating occupancy and to develop new regulations that increase the maximum occupancy allowed in residential dwellings based on the number of adults per dwelling unit, or based on building size or number of sleeping rooms (bedrooms), or by some other method, and present them to Council for consideration no later than [DATE], be approved? ______Yes/For ______No/Against Passed and adopted at a regular meeting of the Council of the City of Fort Collins this 15th day of August 2023. __________________________________ Mayor ATTEST: _____________________________ Chief Deputy City Clerk
