HomeMy WebLinkAbout2023-072-08/15/2023-AUTHORIZING THE SOUND MITIGATION PROJECT FOR NORTHERN COLORADO LAW ENFORCEMENT TRAINING CENTER FIRINRESOLUTION 2023-072 OF THE COUNCIL OF THE CITY OF FORT COLLINS AUTHORIZING THE SOUND MITIGATION PROJECT FOR NORTHERN COLORADO LAW ENFORCEMENT TRAINING CENTER FIRING RANGE WHEREAS,in October 2017,the City and the City of Loveland (collectively,the “Cities”) entered into an initial intergovernmental agreement (IGA)for the sharing of costs for the design and construction administration of a jointly owned police regional training campus,the IGA was updated in March 2019,and the Northern Colorado Law Enforcement training Center (NCLETC) opened for operation in March 2021;and WI-IEREAS,the facility is used by the Cities as well as several outside agencies for a variety of training needs,including firearms training in the firing range;and WHEREAS,after several months of operation,some concerns regarding noise exposure levels were raised by employees of Fort Collins Police Services (FCPS),and in response to those concerns,the City and Colorado State University conducted exposure studies and found that the sound levels were above the acceptable range as determined by the Occupational Safety and Health Administration (OSHA);and WHEREAS,it was determined that the current materials in the firing range are not effective in reducing noise levels appropriately for individuals on the range during firing events and the originally installed noise abatement materials are not functioning as originally expected and need to be replaced with more effective materials;and WHEREAS,temporary modifications to training practices have been put in place to help mitigate the current sound levels but these training modifications are not ideal for long term use at the facility and have created collateral issues such as reduction in the ability to communicate effectively and safely during training;and WHEREAS,in addition to each city using the facility for their own training needs,the Cities provide rental access to the NCLETC to other law enforcement agencies,the revenue from said rentals is placed into a dedicated Capital Fund to offset future costs of administering, operating,maintaining the facility,and funding future capital projects;and W1-IEREAS,in accordance with Section 4 and 10 of the IGA all “Policy Issues”,which include capital projects that exceed $10,000,shall require the approval of each City’s City Council; and WHEREAS,the City of Loveland City Council approved the Capital Project and Appropriation for the NCLETC Sound Mitigation Project on July 18,2023;and WHEREAS,the NCLETC Capital Fund currently has a balance of $441,011;the anticipated cost for the sound mitigation project is $136,632,which will be paid for out of the NCLETC Capital Fund,and there are no additional financial obligations or requests of the City to fund this project;and WHEREAS,the City Council has determined it is in the best interests to approve the NCLETC Sound Mitigation Capital Project for the health and safety of the Cities employees and others who rent or use the facility. NOW,THEREFORE,BE IT RESOLVED BY THE COUNCIL OF THE CITY OF FORT COLLINS as follows: Section 1.That the City findings contained in the recitals above. Council hereby makes and adopts the determinations and Section 2.That the City Council hereby approves and authorizes the Capital Project.
