HomeMy WebLinkAbout121 - 12/21/2021 - DESIGNATING THE MOORE PROPERTY, 528 WEST MOUNTAIN AVENUE, FORT COLLINS, COLORADO, AS A FORT COLLINSORDINANCE NO.121,2021 OF THE COUNCIL OF THE CITY OF FORT COLLINS INVOLUNTARILY DESIGNATING THE MOORE PROPERTY,528 WEST MOUNTAIN AVENUE ORT COLLINS,COLORADO,AS A FORT COLLINS LANDMARK PURSUA TO CHAPTER 14 OF THE CODE OF THE CITY OF FORT COLLIN WHEREAS,pursuant to City Code Section 14-1,the City Coun has established a public policy encouraging the protection,enhancement and perpetuatio f historic landmarks within the City;and WHEREAS,City Code Section 14 31 allows any three more residents of the City to initiate a landmark designation request for a property,with r without the property owner’s consent;and WHEREAS,by resolution adopted on Au st 16,2021,the Historic Preservation Commission (the “Commission”)determined th he Moore Property,528 West Mountain Avenue,in Fort Collins,as more specifically escribed in the legal description below (the “Property”),is eligible for involuntary land k designation pursuant to City Code Chapter 14, Article II,for the Property’s landmark d gnation under Standard 2,Persons/Groups for the property’s association with Jessie Mo e,an early,accomplished educator in Fort Collins; Standard 3,Design/Construction for e property’s status as a significant surviving example of late-nineteenth century architect in the City;and retaining historic integrity of all seven aspects as described in City C e Section 14-22(b);and WHEREAS,the mmission further determined that designation of the Property will advance the policies purposes set forth in City Code Sections 14-I and 14-2 in a manner and extent sufficie o justify designation;and WHE AS,the Commission recommends that the City Council designate the Property as a Fort C ins landmark;and HEREAS,Jason and Misha Green,(the “Owners”of the Property)object to such Ia ark designation and desire to demolish the Property due to health concerns related to ethamphetamine contamination of the Property;and WHEREAS,landmark designation will preserve the Property’s significance to the community;and WHEREAS,the City Council has given due consideration to the Commission’s resolutions and recommendation;the views of the Owners and Applicants,and the testimony, evidence and comment provided at the public hearing held in accordance with City Code Section 14-35;and WHEREAS,the City Council agrees with the recommendation of the Commission and finds that the applicable criteria for designation are met for the Property and,accordingly, desires to designate the Property as a landmark;and Ordinance Defeated on First Reading December 21,2021 WHEREAS,designation of the Property as a landmark is necessary for the prosperity, civic pride,and welfare of the public. NOW,THEREFORE,BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT COLLINS as follows: Section 1.That the City Council hereby makes and adopts the determinations and findings contained in the recitals set forth above. Section 2.That the Council hereby finds that,based on the information and testimony provided for and at the May 18 and August 18 Commission hearings and the December21,2021, Council hearing and the Council’s discussion at that hearing,and review of the record of the Commission hearings,the following two criteria are satisfied with respect to the Property: (1)The Property is eligible for designation as a Fort Collins Landmark in accordance with City Code Chapter 14 for the following reasons: a.That the Property is significant tinder Standard 2,Persons/Group,for its association with Jessie Moore,a long-time educator in the Fort Collins area between 1902 and 1949;and b.That the Property is significant under Standard 3,Design/Construction, as this Property is a rare and well-preserved example of the Folk Victorian style constructed in the 1880’s;and c.That the Property retains a strong preponderance of integrity in all seven aspects:Location,Design,Materials,Workmanship,Setting, Feeling and Association;and (2)The requested designation will advance the policies set forth in City Code Section 14-1 and the purposes stated in City Code Section 14-2,in a manner and extent sufficient to justify the requested designation over the objections of the Homeowners. Section 3.That the Property located in the City of Fort Collins,Larimer County, Colorado,described as follows,to wit: WEST 90 FEET OF LOT 10,BLOCK 61,FORT COLLINS ALSO KNOWN BY STREET AND NUMBER AS 528 WEST MOUNTAIN AVENUE CITY OF FORT COLLINS, COUNTY OF LARIMER,STATE OF COLORADO is hereby designated as a Fort Collins Landmark in accordance with City Code Chapter 14. Section 4.That alterations,additions and other changes to the buildings and structures located upon the Property will be reviewed for compliance with City Code Chapter 14, Article IV,as currently enacted or hereafter amended.
