HomeMy WebLinkAbout2021-068-06/15/2021-Authorizing the execution of the first amendment to intergovernmental agreement regarding the renovar r RESOLUTION 202 1-068 OF THE COUNCIL OF THE CITY OF FORT COLLINS AUTHORIZING THE EXECUTION OF THE FIRST AMENDMENT TO INTERGOVERNMENTAL AGREEMENT REGARDING THE RENOVATION AND REDEVELOPMENT OF TENNEY COURT NORTH ALLEY AND WEST OAK STREET ALLEY WHEREAS,on January 10,2008,the Board of Directors of the Downtown Development Authority,a body corporate and politic (the “DDA”),commissioned Russell +Mills Studios (“R+M”)to prepare a Master Plan for Downtown Alleys and Integrated Walkways for the redevelopment of designated alleys within the boundaries of the DDA (the “Master Plan”);and WHEREAS,the purpose of the Master Plan was to propose improvements to certain alleyways located in or adjacent to the DDA’s boundaries to address deterioration,safety,parking, incompatibility of modes of travel and trash collection practices,leading to a more visually pleasing appearance in the alleyways and a “shared street”concept whereby the alleyways would be more conducive to vehicle,pedestrian and bicycle traffic,and provide greater connectivity between Fort Collins Downtown,the Colorado State University campus and the Fort Collins River District;and WHEREAS,on May 18,2010,the Fort Collins City Council adopted Resolution 2010-027 authorizing the City Manager to execute the intergovernmental agreement by and between the City and the DDA relating to the construction,operation and maintenance of the Montezuma Fuller Alley and Old Firehouse Alley improvements (the “2010 IGA”);and WHEREAS,on February 1,2011,the Fort Collins City Council adopted Resolution 2011- 006 authorizing the City Manager to execute a separate IGA with the DDA relating to the construction,operation,and maintenance of the West Myrtle Alley (the “2011 IGA”);and WHEREAS,in 2014 the DDA and the City negotiated and agreed upon that certain “Intergovernmental Agreement Regarding Maintenance of Certain Downtown Alleys”,under which the DDA pays the City to perform certain maintenance services within the alleys redeveloped under the 2010 IGA and 2011 IGA (the “Maintenance IGA”);and WHEREAS,the construction of the Alley Enhancements is consistent with and in furtherance of the Downtown Plan;and WHEREAS,on January 5,2021,the Fort Collin City Council adopted Resolution 2021- 001,authorizing the City Manager to execute an intergovernmental agreement with the DDA relating to the renovation and redevelopment of Tenney Court North Alley and West Oak Street Alley (the “2021 IGA”);and WHEREAS,on January 29,2021,the City and the DDA entered into the 2021 IGA;and r WHEREAS,pursuant to the 2021 IGA,the City authorized the DDA to construct Alley Enhancements within City rights-of-way located within Tenney Court North Alley and West Oak Street Alley;and WHEREAS,the Alley Enhancements were approved through the City’s Capital Projects Review Process;and WHEREAS,certain of the Alley Enhancements for Tenney Court North Alley are outside of the alley right-of-way and include improvements to the City-owned property located at 144 North Mason Street,which contains the Civic Center Parking Structure and abuts Tenney Court North Alley (the “Mason Street Property”);and WHEREAS,the Alley Enhancements approved envisioned for the Mason Street Property generally consist of installation of concrete payers,benches,landscaping planters and other features on surface areas abutting Tenney Court North Alley;and installation of festoon lighting attachments,wall-mounted planter baskets,new and replacement LED lighting,and a mural along the north,east and south facades of the Civic Center Parking Structure;and WHEREAS,the Mason Street Property is not a right-of-way and the construction of Alley Enhancements on such property is not authorized by the IGA;and WHEREAS,the City and DDA desire to enter into the First Amendment to the 2021 IGA substantially in the form attached hereto as Exhibit “A”and incorporated herein by reference (the “First Amendment”)to permit completion of the Alley Enhancements on the Mason Street Property,clari&the maintenance obligations originally set forth on Exhibit C to the 2021 IGA; and make other modifications as set forth therein;and WHEREAS,Article II,Section 16 of the City Charter empowers the City Council,by ordinance and resolution,to enter into contracts with governmental bodies to furnish governmental services and make charges for such services,or enter into cooperative or joint activities with other governmental bodies;and WHEREAS,Section 29-1-203 of the Colorado Revised Statutes (“C.R.S.”)also provides that governments may cooperate or contract with one another to provide certain services or facilities when such cooperation or contracts are authorized by each party thereto with the approval of its legislative body or other authority having the power to so approve;and WHEREAS,Section 1-22 of the City Code also provides that intergovernmental agreements and other cooperative arrangements between the City and other governmental entities are to be submitted to the City Council for re~iew,unless they fit within one of the exceptions that permit execution by the City Manager;and WHEREAS,pursuant to C.R.S.Section 31-25-808,the DDA has authority to make public improvements which benefit those downtown areas of Fort Collins within its boundaries;and C WHEREAS,pursuant to C.R.S.Section 31-25-808,the DDA is empowered to cooperate with the City and to enter into contracts with the City,including the First Amendment;and WHEREAS,the City Council has determined that the First Amendment of the 2021 IGA to address the Alley Enhancements on the Mason Street Property is in the best interests of the City. NOW,THEREFORE,BE IT RESOLVED BY THE COUNCIL OF THE CITY OF FORT COLLINS,as follows: Section 1.That the City Council hereby makes any and all determinations and findings contained in the recitals set forth above. Section 2.That the City Manager is hereby authorized to execute the First Amendment to Intergovernmental Agreement Regarding The Renovation And Redevelopment of Tenney Court North Alley And West Oak Street Alley substantially in the form attached hereto as Exhibit “A,” with such modifications and additions as the City Manager,in consultation with the City Attorney, determines to be necessary and appropriate to protect the interests of the City or effectuate the purposes set forth herein and not otherwise inconsistent with this Resolution. Passed and adopted at a regular meeting of the Council of the City of Fort Collins this 15th day of June,AD.2021. ~1 ATTEST: _____L — City Clerk EXHIBIT A FIRST AMENDMENT TO INTERGOVERNMENTAL AGREEMENT REGARDING THE RENOVATION AND REDEVELOPMENT OF TENNEY COURT NORTH ALLEY AND WEST OAK STREET ALLEY This FIRST AMENDMENT TO INTERGOVERNMENTAL AGREEMENT REGARDING THE RENOVATION AND REDEVELOPMENT OF TENNEY COURT NORTH ALLEY AND WEST OAK STREET ALLEY (“Amendment”)is made and executed this ________day of _______________,2021,by and between the CITY OF FORT COLLINS, COLORADO,a municipal corporation (the “City”),and the FORT COLLINS,COLORADO, DOWNTOWN DEVELOPMENT AUTHORITY,a body corporate and politic (the “DDA”). themed images depicted on Exhibit F,consisting of two (2)pages,attached hereto and incorporated herein by reference,in locations substantially similar to those depicted on Exhibit F,which include the southeast elevator tower,as well the east and south facades,of the Civic Center Parking Garage. ii.Removal of ten (10)existing wall-mounted sodium light fixtures and their replacement with nine (9)L.E.D.wall mounted light fixtures,with a design substantially similar to that depicted on Exhibit C,consisting of one (1)page, attached hereto and incorporated herein by reference,in locations substantially similar to those depicted on Exhibit H,consisting of six (6)pages,attached hereto and incorporated herein by reference. iii.Seven (7)security cameras,with a design substantially similar to that depicted on Exhibit I,consisting of one (I)page,attached hereto and incorporated herein by reference,in locations substantially similar to those depicted on Exhibit H,and associated electrical wiring and conduit. iv.Two (2)L.E.D.can light fixtures and two-hundred (200)linear feet of accent rope lighting,with designs substantially similar to that depicted on ExhibitS,consisting of one (I)page,attached hereto and incorporated herein by reference,to be attached to the underside of the pedestrian bridge that spans North Tenney Court Alley between the east façade of the Civic Center Parking Structure and the Opera Galleria Building at 123 North College Avenue,and associated electrical wiring and conduit. v.Fifteen (15)hanging planter baskets,with a design substantially similar to
