HomeMy WebLinkAbout2022-113-11/15/2022-TO DECLINE THE CITY OF FORT COLLINS’S PARTICIPATION IN THE COLORADO PAID FAMILY AND MEDICAL LEAVE INRESOLUTION2022-113OFTHECOUNCILOFTHECITYOFFORTCOLLTNSTODECLINETHECITYOFFORTCOLLINS’SPARTICIPATIONINTHECOLORADOPAIDFAMILYANDMEDICALLEAVEINSURANCEPROGRAMWHEREAS,inNovember2020.ColoradovotersapprovedProposition118,whichledtothecreationofastate-runPaidFamilyandMedicalLeaveInsurance(“FAMLI”)program;andWHEREAS,FAMLIiscodifiedatColoradoRevisedStatues(“C.R.C.”)Sections8-13.3-501through-524,andisadministeredthroughtheColoradoDepartmentofLaborandEmployment,DivisionofFamilyandMedicalLeaveInsurance;andWHEREAS,alocalgovernmentmaydeclineallparticipationintheFAMLIprogrambyavoteofitsgoverningbodyunderC.R.S.Section8-13.3-522,andinterestedemployeesmaystillelecttoparticipateindividuallyunderCR5.Section8-13.3-514:andWHEREAS,onNovember7,2022,allCityemployeeswereprovidedanoticeofthescheduledCouncilconsiderationoftheCityManagerrecommendationtodeclineparticipationintheFAMLIprogram,invitingthemtoprovideinputonthematterforconsiderationbytheCityCouncil;andWHEREAS,theCityCouncilheldahearingregardingtheCity’sparticipationintheFAMLIprogramonNovember15,2022,duringwhichemployeesweregiventheopportunitytosubmitcommentstoCityCouncilregardingtheFAMLIprogram;andWHEREAS,CityCouncilhasdeterminedtomakealocaldecisionastohowtoprovidebenefitsandprotectionstoCityemployeesanddeclinesparticipationintheFAMLIprogram.NOW,THEREFORE,BEITRESOLVEDBYTHECOUNCILOFTHECITYOFFORTCOLLINSasfollows:Section1.ThattheCityCouncilherebymakesandadoptsthedeterminationsandfindingscontainedintherecitalssetforthabove.Section2.ThattheCityCouncilasthegoverningbodyoftheCityofFortCollinsherebyformallyresolvestodeclineparticipationbytheCityinthePaidFamilyMedicalLeaveInsurance(“FAMLI”)programunderC.R.S.Section8-13.3-522.Section3.ThattheCityManagerorherdesigneeareherebyauthorizedanddirectedtotakeallactionsnecessarytoimplementtheprovisionsofSection2above,includingprovidingformalnoticetotheColoradoDepartmentofLaborandEmployment,DivisionofFamilyandMedicalLeaveInsurance,regardingtheCity’sdecisiontodeclineallparticipationintheFAMLIprogram.
