BUDGERESOLUTION2022-110OFTHECOUNCILOFTHECITYOFFORTCOLLINSAPPROVINGTHEMIDTOWNBUSINESSIMPROVEMENTDISTRICT2022AND2023OPERATINGPLANSANDPROPOSEDBUDGETSANDAPPOINTINGDISTRICTDIRECTORSWHEREAS,onDecember5,2017,theCityCounciladoptedOrdinanceNo.165,2017,creatingtheMidtownBusinessImprovementDistrict(the“District”)inaccordancewiththeprovisionsoftheBusinessImprovementDistrictActinPart12ofArticle25inTitle31oftheColoradoRevisedStatutes(the“Act”);andWHEREAS,Section31-25-1211oftheAct,requiresabusinessimprovementdistrict(“BID”)tosubmitbySeptember30ofeachyeartotheclerkofthemunicipalitythatestablishedit,theBID’sproposedoperatingplanandproposedbudgetfortheupcomingyear;andWHEREAS,onSeptember29,2021,theDistricttimelysubmittedtotheCityClerktheDistrict’sproposed2022operatingplan,acopyofwhichisattachedasExhibit“A”andincorporatedhereinbyreference(the“2022OperatingPlan”),andtheDistrict’sproposed2022budget,acopyofwhichisattachedasExhibit“B”andincorporatedhereinbyreference(the“2022Budget”);andWHEREAS,itwasrecentlydiscoveredthat,duetoanoversight,the2022OperatingPlanandthe2022BudgetwerenotpresentedtoCityCouncilin2021foritsconsiderationandapproval;andWHEREAS,onSeptember30,2022,theDistricttimelysubmittedtotheCityClerktheDistrict’sproposed2023operatingplan,acopyofwhichisattachedasExhibit“C”andincorporatedhereinbyreference(the“2023OperatingPlan”),andtheDistrict’sproposed2023budget,acopyofwhichisattachedasExhibit“D”andincorporatedhereinbyreference(the“2023Budget”);WHEREAS,Section31-25-1211oftheActprovidesthattheCityCouncilshalleitherapproveordisapprovethe2023OperatingPlanandthe2023BudgetbyDecember5,2022,and,ifapproved,theDistrict’sservices,improvementsandfinancialarrangementsfor2023aretoconformasfaraspracticabletothe2023OperatingPlanandthe2023BudgetunlessamendedwiththeCityCouncil’spriorapproval;andWHEREAS,theCityCouncilhasreviewedthe2023OperatingPlanandthe2023BudgetandfindsanddeterminesthattheysatisfytherequirementsoftheActandshouldbeapproved;andWHEREAS,theCityCouncilhasalsoreviewedthe2022OperatingPlanandthe2022Budgetand,whiletheywerenotpreviouslyapprovedbyCouncilbytheDecember5,2021,deadlineasrequiredunderSection31-25-1211becauseoftheCity’soversight,theCouncilfindsanddeterminesthattheysatisfytherequirementsoftheActfortheyear2022andshouldbeapprovedretroactivelytoDecember5,2021,tothefullextentpermittedbylaw.—1— NOW,THEREFORE,BEITRESOLVEDBYTHECOUNCILOFTHECITYOFFORTCOLLINSasfollows:Section1.ThattheCityCouncilherebymakesandadoptsthedeterminationsandfindingscontainedintherecitalssetforthabove.Section2.Thatthe2023OperatingPlanandthe2023Budgetareherebyapprovedand,asrequiredbytheAct,theDistrict’s2023services,improvementsandfinancialarrangementsshallconformasfaraspracticablewiththe2023OperatingPlanandthe2023Budget.Section3.ThattheDistrict’sdirectorsandtheircorrespondingtermssetforthinthe2023OperatingPlanareherebyappointedandapproved.Section4.Thatthe2022OperatingPlanandthe2022BudgetareherebyratifiedandapprovedretroactivelytoDecember5,2021,and,asrequiredbytheAct,theDistrict’s2022services,improvementsandfinancialarrangementsshallconformasfaraspracticablewiththe2022OperatingPlanandthe2022Budget.PassedandadoptedatadayofNovember,A.D.2022.ATTEST:CityofFortCollinsthis15thCityIf-2- EXHIBITAMidtownBusinessImprovementDistrict(BID)2022OperatingPlanBIDNAMETheBIDshalloperateastheMidtownBusinessImprovementDistrict(BID).LEGALAUTHORITYABIDinColoradoisorganizedpursuanttotheBusinessImprovementDistrictAct,Section31-25-1201etseq.,ColoradoRevisedStatutes.ABIDislegallycreatedviathefollowingprocess:•StakeholdersacquirepetitionsignaturesofcommercialpropertyownersrepresentingamajorityofthetotalassessedvalueandamajorityofthetotalacreageoftheproposedBIDarea.•TheCityadoptsanordinanceestablishingthedistrict,followingnoticeandapublichearing.ABOUTMIDTOWNMidtownisagrowing,thrivinghubincentralFortCollins.ThepropertiesadjacenttoCollegeAvenue,fromDraketoBoardwalk,aswellastheFoothillsMallpropertieslocatedonFoothillsParkway,makeupMidtown.Intotal,thecorridorspansslightlyoveroneandahalfmiles.Today,Midtownisanactiveplacewithawiderangeofcommercialactivitiesandalimitedamountofresidentialandinstitutionaluses.Automobiledealershipsmakeupasignificantportionofthebusinessmix,whilebigboxretailers,andin-linestripretailcharacterizetheshoppingoffer.Withinthelastfewyears,therehasbeenrenewedcommitmenttoandinterestinsupportingarevitalizedMidtownwithafocusonalong-termstrategytosupportthestrengthofthedistrict,bothphysicallyandeconomically.THEVISIONFORMIDTOWNMidtownstakeholdershavebeenworkingtogetherforthelast10yearsthroughsignificantplanningeffortstoenvisionarefreshedfutureforthedistrict,onethatcontinuestoinvigoratetheareawithdestinationretail,higher-densitydevelopment,commercialopportunities,anduniqueurbanliving.TheformationoftheBIDbroughtwithitacommitmenttoestablishadistinctiveidentity,placemaking,events,activitiesandpeople-orientedusestoestablishavibrantanddynamicshoppingandentertainmentareaintheheartofFortCollins.HistoricallycharacterizedasthestripretailcorridorofFortCollins,theemergingvisionforMidtownwillincorporateurbanredevelopment,urbandesign,andenhancedpedestrianspacestobeginalongtermtransitiontoaplacewherecitizensneedtogoforservicesbutwanttostayoncetheyarrive.ContinuousBIDandCityinvestmentinrevitalizationwillensuretheCity’sComprehensivePlanofthecorridorwillberealizedandtheretailcoreofthecommunitywillbestable.THEBID’SROLEINMIDTOWNTheMidtownBIDprovidesasustainablefundingsourcetoleveragepublicsectorinvestmentsandprovideprivatesectorstakeholdersintheareawithastrongerplatformthroughwhichtoadvocatefor—anddirectlyfurid—neededimprovementsasMidtowncomesintoanewera.TheMidtownBIDaimsto;•Createacollectivevoicetoaccomplishthegoalsoftheneighborhood,provideleadershipfortheneighborhood,andchampionthevisionofMidtown.-ServeastheactivatoroftheMidtownneighborhood,providingprogramming,marketingandactivitiesyear-round.•PurposefullyimproveandadvanceMidtownurbandesigntofacilitateeconomicgrowthandoverallincreasedvitalityinMidtown.•DevelopandestablishMidtown’scharacterandpersonality,communicateitsuccinctly,andbringittolife.WorkingwiththeCity’spreviouslydevelopedMidtownPlanandMidtowninMotionPlan,variousimprovementsareenvisionedoverthenext10-15yearsthatwilltransformtheMidtownCorridorfromclassicsuburbanstrip,tovitalexcitingurbanform.1 EXHIBITA•CreatesynergisticrelationshipswiththeCityofFortCollinstocreateanaccessibleanddesirableplaceforlocalsandvisitors.•Findinteresting,activeandcreativeusesforshops,sidewalksandopenspacesthatcanboosttheeconomy,thusdiversifyingthemixandaddingnewbusinessopportunities.•Provideawareness,recognition,promotionandeducationaboutMidtown.•KeepMidtownsafe,cleanandwelcoming.•BeanadministrativeumbrellathatbringstheneighborhoodtogetherandmaximizesfundingopportunitiesforthefutureofMidtown.BIDBOUNDARIESTheMidtownBIDincludesparcelsfrontingSouthCollegeAvenuefromDrakeRoadinthenorthtoBoardwalkDriveinthesouth,aswellasthosefrontingEastFoothillsParkwaybetweenEastSwallowRoadandSouthCollegeAvenueintheCityofFortCollins,CountyofLarimer,StateofColorado.BIDSERVICESThespecifictypesofservicesthattheBIDinthefuturewillfundweredevelopedandprioritizedbythebusinessandpropertyownersofMidtown,andinclude:•MidtownPromotion,Management,andBusinessSupport:TheBIDaimstobethego-toresourceforMidtown,providingleadershipandbusinesssupport,whilechampioningstakeholders’needstocreateanenvironmentthat’swelcomingtothelargercommunityandvisitors.Projectstosupportthestakeholderswillinclude:-AdministrativesupporttohelpmanageMidtown,advocateforMidtownneeds,andfocusonleveragingresourcesandimprovementsforthearea.-PromotionofMidtowncommercialsectordevelopmentthatsupportsstrategiceconomicgrowthandcreatesavibrantenvironmentinwhichMidtownbusinessescanthrive.-SupplementingtheBIDbudgetandidentifyingstrategicfundingopportunitiestoleverageandenhancethebaseassessmentscollectedfromyeartoyear.-Buildingpartnershipsanddevelopingstrategiestoincreasecommunityparticipation,leadershipandcoordination,including(butnotlimitedto)partnershipswiththeCityofFortCollins,theMidtownBusinessAssociation,theFortCollinsDowntownDevelopmentAuthorityandtheDowntownFortCollinsBusinessAssociation.-ProvidingbusinesssupportforMidtownbusinesses,servingasthe“concierge”forallthingsMidtownandhelpingbusinessessucceedbyprovidingthemwithusefultoolsandresources,includingtrackingpolicies,data,andotherusefulinformation.-Shapingtheretail,restaurantandoverallstorefrontexperienceinMidtownbydevelopingandimplementingastrategyforstrengtheningtheofferonthegroundlevelandenhancingtheexistingbusinessmixinMidtown.-GrowingthebaseofMidtowntolengthentheurbaninfluencearea.•MidtownBranding,Marketing,andActivation:TheBIDaimstodevelopanddeliverauniqueexperiencethatencourageslocalsandvisitorstoexploreMidtown,andtoestablishastrongidentitythatisrecognizableandhighlightsthedistinctiveMidtownoffer.Projectsinclude:-Developmentofanauthentic,compellingandclearbrandforMidtownthatuniquelyidentifiesitsofferandpotential.-Producingtargetedmarketingandmessagingtothecommunityandvisitors.-Developingandpartneringonyear-roundprogramming,eventsandactivitiesthatdrawindiversedemographicgroupstoexperienceandexploreMidtownandgivethemareasontostay,exploreandspendmoneyinthedistrict.2 EXHIBITAPublicandcommunityrelationsinsupportofgrowingtheMidtowncorridorthathelppromotewhyMidtownisadestinationinitsownright.MidtownPlacemakingandMaintenance:TheBIDwillworktoactivatethepublicrealminMidtownanddevelopaclean,safeandfriendlyenvironment,offeringenhancementsandamenitiesthatcreateawelcomingdestinationandsupportlarger-scaleinfrastructureprojectsproposedforthearea.Projectswillinclude:-CreationofauniqueMidtownambianceandsenseofplacethatissafe,accessible,walkableandeasytopark.-DevelopmentofaunifyingaestheticforMidtown’spublicspacesandrightofwaythroughtheadditionofpublicrealmamenitiesthroughoutMidtown,includingmorebenches,bikeracks,publicartandtrash/recyclingcans.-InvestmentsinuniqueMidtownwayfindingsignageandgatewaysthatcreateasenseofplaceandhelpguestsexploretheareawhetherbycar,bybicycle,oronfoot.-Addingcolorandvibrancytothedistrictbyfundingbanners,holidaylightingandpublicart.BIDASSESSMENTMETHODANDBUDGETTheBIDwillutilizeanassessmentmethodthatisbaseduponlinearfrontageofapropertyonCollegeAvenueandFoothillsParkwaywithintheBIDboundary.Theassessmentwillbe$10perlinearfoot,annually.Onlycommercially-assessedpropertieswillbeincluded.TheBIDwillraiseapproximately$160,000.Additionally,theBIDwillhavetheabilitytoraisetheassessmentannuallynottoexceedtheConsumerPriceIndexforallUrbanConsumers(CPI-U)fortheDenver-Boulder-Greeley,Coloradometropolitanarea.ThisdecisionwillbeatthediscretionoftheBIDboard.BringinginrevenueandcontributionsinadditiontotheBIDassessmentwillincreaseimpactandhelptheorganizationtobestleverageinvestmentsintoMidtown.Tothatend,theBIDwillworktoprocuresupportingfundingfromtheCityofFortCollinsaswellasgrants,donations,sponsorships,memberships,fee-for-serviceprojects,crowdsourcingandpartnershipsontopoftheBIDspecialassessment.TheBIDBoard,withCityapproval,woulddeterminetheannualoperatingbudgeteachyearofBIDoperations,basedupontheprioritiessetoutinthisplan.Propertiesadjacentto,butnotwithintheBIDboundaries,mayelecttoparticipateintheBID.Uponrequest,theBIDwouldprovidetechnicalassistancetohelp.Todoso,theownersofsuchpropertieswouldberequiredtofileawrittenpetitionwiththeCityofFortCollins,requestingthattheirpropertybeincludedintheBID,Thepetitionshallbeaccompaniedbyadepositofmoneysufficienttopayallcostsoftheinclusionorexclusionproceedings.Publicnoticewillbegiven,apublichearingwillbeheldandanordinancemaybeadoptedbyFortCollinsCityCouncil.ThedeterminationofassessmentforpropertiesjoiningtheBIDwhichdonothavefrontageoneitherCollegeAvenueorFoothillsParkwayshallbeassessedthesamefrontagerateastherestoftheBIDfortheirparticularfrontageonthestreettheyarelocated.3 EXHIBITA2022ProposedBIDBudgetandServicesThefollowingtablelaysouttheproposed2022budgetfortheMidtownBID,aswellassomeconsiderationsforeachproposedexpenditure:ExpenditurtctAnnualBudgetAmountStaff/AdministrationHiringeffectivestaff/contractorstosupporttheboardandadminister$36,000theprogramsandprojectswillbeacriticalfirststepfortheBID.Branding,MarketingandActivationIn2022,theBIDwillcontinuetobuildontheworkdonein2020tobrand$50000theBIDandputmorefocusandattentiononthefocuswillbeonbuildingonthebrandthroughthecommunitywhileworkingonspecificcampaignstohelpbusinesssales.PlacemakingandMaintenanceAcriticalaspectoftheBIDworkistoenhancethevisibleimpactonthedistrict.TheBIDwillcontinuetoleverageCityandotherfundingtoimplementnotableurbanprojects.$100,000OtherFeesThesemayinclude:•1%collectionfeeforBIDFundsLegalcosts$31,750Accounting•CreationofareserveaccountTOTAL2022BUDGET$217,7s0ContinuingtobuildtheBIDbrand,solicitfeedbackfromtheratepayerswillestablishsuccessintheearlyyearswillenabletheBIDtoattractmoreparticipantsandgrowthebase.Withrevenuesbeingspentonmarketing,urbandesign,andpromotion,thevisualinfluenceandfuturerevenuepotentialwillgrowmuchasithasindowntown.BIDBONDINGAsallowedbylaw,theBIDmayissuebondsorothermultiple-yearfinancialobligationsonlyiftheBIDisauthorizedtodosobyitsoperatingplan,budgetanditsvotersinafutureelection.Theelectionmustcomplywithallapplicablestaterequirements,includingtheTABORAmendment,andwouldlimittheamountofdebtthatmaybeissuedtonomorethantheamountthatisapprovedbytheBIDvoters.4 EXHIBITABIDGOVERNANCETheBIDstatuteallowsforaboardof5tollmemberswhoareBIDelectors.TheMidtownBIDboardcurrentlyconsistsofthefollowingnine(9)appointedmembersfromtheMidtownBIDarea;RationaleforInclusiononBoardMemberAffiliationBoardLongstandingFortCollinsbusinessownerwillhelprepresenttherestaurantusersJohnHoxmeirGildedGoatBrewingalongthecorridorLongstandingFortCollinsbusinessownerandresidentwhohasparticipatedandwillRaynoSeaserTheEgg&I/FirstWatchRestaurantsalsohelprepresenttherestaurantusersalongthecorridorLongstandingFortCollinsbusinessownerandresidentMikeDellenbachDellenbachChevroletwhowillhelprepresentthecardealersalongthecorridorWellestablishedandrespectedmemberoftheDavidFritzlerBBVAbusinesscommunitywhowillhelprepresentthefinancialinstitutionsalongthecorridorLongstandingFortCollinsbusinessownerandresidentSpiroPalmerPalmerPropertieswhowillhelprepresenttheshoppingcentersandgeneralbusinessesalongthecorridorFormerpresidentoftheSFCBANobleVenture!RepresentativeofleadingtheeffortstoformtheLukeMcFetridgeMidtownBusinessMootHouseBIDandrealestateowneranddeveloperGMofFoothillsMall,representingacatalystprojectinMidtownandPatrickBunyardFoothillsMalldemonstratingtheMall’scommitmenttotheBIDbyserving_ontheboardLongstandingresidentandLaurenDeRosaWildBirdsUnlimitedNatureShopbusinessownerinFortCollins5 EXHIBITAIandwillhelprepresenttheIbusinesslesseesChiefOperatingOfficerofCarrieBaumgartMarkleyMotorsMarkleyMotorsrepresentingthecardealersinthedistrictThetermsofofficehavebeenstaggeredtoencouragecontinuityinBIDgovernance.Themaximumlengthofeachtermisthree(3)yearsandtheconsecutivetermlimitistwo(2)terms.Afteramemberhasfulfilledtwoconsecutiveterms,thatpersonmaynotbeamemberoftheMidtownBIDgoverningbodyforthree(3)yearsbeforebeingreappointed.BIDTERMBIDsinColoradomaybeperpetual.However,theMidtownBIDwillhaveaninitialten-yearterm.ThiswillallowforpropertyandbusinessownerstoevaluatetheBID’seffectivenessattheendoftheterm.IftheBIDisdeemedsuccessful,theBIDBoardwillrequestthattheCityCouncilrenewtheBIDbyordinanceaftertheinitialperiod.IftheBIDisnotconsideredtobesuccessful,itwillsunsetattheendoftheinitialterm.CITYSERVICESBIDserviceswillbedesignedtosupplementexistingCityservicesandwillbeinadditiontoCityservicesthatarecurrentlyprovidedinMidtown.BIDserviceswillnotreplaceanyexistingCityservices.TheMidtownBIDwillprovideanumberofbenefitstotheCityofFortCollins,including:•AcollectiveleaderandchampionforthevisionofMidtown,andclearpartnerwithwhichtheCitycanwork•HelptheCityofFortCollinsadvanceitskeystrategicobjectives•Cleareconomicbenefits,includingbutnotlimitedto:-Increasedsalesrevenuethroughtheactivation,marketingandpromotionofMidtowncreatingmorevisitorsandmorespendinginthearea-DevelopmentofMidtownasanentertainmentandshoppinghub-Interesting,activeandcreativeusesforshops,sidewalksandopenspaces•OpportunitytofurtherdemonstratethecommitmenttoMidtownoutlinedintheCity’sMidtownPlan•CreateasecondactivitycenterinFortCollinsanda“place”beyonddowntowninFortCollinsforvisitorsandlocals•BeautificationoftheCitythrougharefreshedandinvigoratedareaANNUALREVIEWTheBIDActrequirestheBIDtofileanannualoperatingplanandbudgetwiththeCityonorbeforeSeptember30ofeachyear.TheCitywillreviewandapprovetheoperatingplanandbudgetasprovidedbylaw.6 EXHIBITADISSOLUTIONUnderColoradolaw,theBIDmaybedissolvedfollowingapublichearingifpropertyownersrepresentingatleast50%ofacreagewithintheBIDandatleast50%oftotalassessedvaluewithintheBIDsubmitpetitionsfordissolutiontoCityCouncil.CityCouncilalsoretainsdiscretiontoinitiatedissolutionproceedingsiftheBIDfailstosubmitanoperatingplanandbudgetfortwosuccessiveyears.7 EXHIBITCMidtownBusinessImprovementDistrict(BID)2023OperatingPlanBIDNAMETheBIDshalloperateastheMidtownBusinessImprovementDistrict(BID).LEGALAUTHORITYABIDinColoradoisorganizedpursuanttotheBusinessImprovementDistrictAct,Section31-25-1201etseq.,ColoradoRevisedStatutes.ABIDislegallycreatedviathefollowingprocess:•StakeholdersacquirepetitionsignaturesofcommercialpropertyownersrepresentingamajorityofthetotalassessedvalueandamajorityofthetotalacreageoftheproposedBIDarea.•TheCityadoptsanordinanceestablishingthedistrict,followingnoticeandapublichearing.ABOUTMIDTOWNMidtownisagrowing,thrivinghubincentralFortCollins.ThepropertiesadjacenttoCollegeAvenue,fromDraketoBoardwalk,aswellastheFoothillsMallpropertieslocatedonFoothillsParkway,makeuptheMidtownBID.Intotal,thecorridorspansslightlyoveroneandahalfmiles.Today,Midtownisanactiveplacewithawiderangeofcommercialactivitiesandalimitedamountofresidentialandinstitutionaluses.Automobiledealershipsmakeupasignificantportionofthebusinessmix,whilebigboxretailers,andin-linestripretailcharacterizetheshoppingoffer.Withinthelastfewyears,therehasbeenrenewedcommitmenttoandinterestinsupportingarevitalizedMidtownwithafocusonalong-termstrategytosupportthestrengthofthedistrict,bothphysicallyandeconomically.THEVISIONFORMIDTOWNMidtownstakeholdershavebeenworkingtogetherforthelasttenyearsthroughsignificantplanningeffortstoenvisionarefreshedfutureforthedistrict,onethatcontinuestoinvigoratetheareawithdestinationretail,higher-densitydevelopment,commercialopportunities,anduniqueurbanliving.TheformationoftheBIDbroughtwithitacommitmenttoestablishadistinctiveidentity,placemaking,events,activitiesandpeople-orientedusestoestablishavibrantanddynamicshoppingandentertainmentareaintheheartofFortCollins.HistoricallycharacterizedasthestripretailcorridorofFortCollins,theemergingvisionforMidtownwillincorporateurbanredevelopment,urbandesign,andenhancedpedestrianspacestobeginalongtermtransitiontoaplacewherecitizensneedtogoforservicesbutwanttostayoncetheyarrive.ContinuousBIDandCityinvestmentinrevitalizationwillensuretheCity’splanningeffortsforthecorridorwillberealizedandtheretailcoreofthecommunitywillbestable.THEBID’SROLEINMIDTOWNTheMidtownBIDprovidesasustainablefundingsourcetoleveragepublicsectorinvestmentsandprovideprivatesectorstakeholdersintheareawithastrongerplatformthroughwhichtoadvocatefor—anddirectlyfund—neededimprovementsasMidtowncomesintoanewera.TheMidtownBIDaimsto:•Createacollectivevoicetoaccomplishthegoalsoftheneighborhood,provideleadershipfortheneighborhood,andchampionthevisionofMidtown.•ServeastheactivatoroftheMidtownneighborhood,providingprogramming,marketingandactivitiesyear-round.•PurposefullyimproveandadvanceMidtownurbandesigntofacilitateeconomicgrowthandoverallincreasedvitalityinMidtown.•DevelopandestablishMidtown’scharacterandpersonality,communicateitsuccinctly,andbringittolife.WorkingwiththeCity’spreviouslydevelopedMidtownPlanandMidtowninMotionPlan,variousimprovementsareenvisionedoverthenext10-15yearsthatwilltransformtheMidtownCorridorfromclassicsuburbanstrip,tovitalexcitingurbanform,1 EXHIBITC-CreatesynergisticrelationshipswiththeCityofFortCollinstocreateanaccessibleanddesirableplaceforlocalsandvisitors.•Findinteresting,activeandcreativeusesforshops,sidewalksandopenspacesthatcanboosttheeconomy,thusdiversifyingthemixandaddingnewbusinessopportunities.•Provideawareness,recognition,promotionandeducationaboutMidtown.-KeepMidtownsate,cleanandwelcoming.•BeanadministrativeumbrellathatbringstheneighborhoodtogetherandmaximizesfundingopportunitiesforthefutureofMidtown.BIDBOUNDARIESTheMidtownBIDincludesparcelsfrontingSouthCollegeAvenuefromDrakeRoadinthenorthtoBoardwalkDriveinthesouth,aswellasthosefrontingEastFoothillsParkwaybetweenEastSwallowRoadandSouthCollegeAvenueintheCityofFortCollins,CountyofLarimer,StateofColorado.BIDSERVICESThespecifictypesofservicesthattheBIDwillfundweredevelopedandprioritizedbythebusinessandpropertyownersofMidtown,andinclude:•MidtownPromotion,Management,andBusinessSupport:TheBIDaimstobethego-toresourceforMidtown,providingleadershipandbusinesssupport,whilechampioningstakeholders’needstocreateanenvironmentthat’swelcomingtothelargercommunityandvisitors.Projectstosupportthestakeholderswillinclude:-AdministrativesupporttohelpmanageMidtown,advocateforMidtownneeds,andfocusonleveragingresourcesandimprovementsforthearea.-PromotionofMidtowncommercialsectordevelopmentthatsupportsstrategiceconomicgrowthandcreatesavibrantenvironmentinwhichMidtownbusinessescanthrive.-SupplementingtheBIDbudgetandidentifyingstrategicfundingopportunitiestoleverageandenhancethebaseassessmentscollectedfromyeartoyear.-Buildingpartnershipsanddevelopingstrategiestoincreasecommunityparticipation,leadershipandcoordination,including(butnotlimitedto)partnershipswiththeCityofFortCollins,theMidtownBusinessAssociation,theFortCollinsDowntownDevelopmentAuthorityandtheDowntownFortCollinsBusinessAssociation.-ProvidingbusinesssupportforMidtownbusinesses,servingasthe“concierge”forallthingsMidtownandhelpingbusinessessucceedbyprovidingthemwithusefultoolsandresources,includingtrackingpolicies,data,andotherusefulinformation.-Shapingtheretail,restaurantandoverallstorefrontexperienceinMidtownbydevelopingandimplementingastrategyforstrengtheningtheofferonthegroundlevelandenhancingtheexistingbusinessmixinMidtown.-GrowingthebaseofMidtowntolengthentheurbaninfluencearea.•MidtownBranding,Marketing,andActivation:TheBIDaimstodevelopanddeliverauniqueexperiencethatencourageslocalsandvisitorstoexploreMidtown,andtoestablishastrongidentitythatisrecognizableandhighlightsthedistinctiveMidtownoffer.Projectsinclude:-Developmentofanauthentic,compellingandclearbrandforMidtownthatuniquelyidentifiesitsofferandpotential.-Producingtargetedmarketingandmessagingtothecommunityandvisitors.-Developingandpartneringonyear-roundprogramming,eventsandactivitiesthatdrawindiversedemographicgroupstoexperienceandexploreMidtownandgivethemareasontostay,exploreandspendmoneyinthedistrict.2 EXHIBITCPublicandcommunityrelationsinsupportofgrowingtheMidtowncorridorthathelppromotewhyMidtownisadestinationinitsownright.•MidtownPlacemakingandMaintenance:TheRIDwiltworktoactivatethepublicrealminMidtownanddevelopaclean,safeandfriendlyenvironment,offeringenhancementsandamenitiesthatcreateawelcomingdestinationandsupportlarger-scaleinfrastructureprojectsproposedforthearea.Projectswillinclude:-CreationofauniqueMidtownambianceandsenseofplacethatissafe,accessible,walkableandeasytopark.-DevelopmentofaunifyingaestheticforMidtown’spublicspacesandrightofwaythroughtheadditionofpublicrealmamenitiesthroughoutMidtown,includingmorebenches,bikeracks,publicartandtrash/recyclingcans.-InvestmentsinuniqueMidtownwaytindingsignageandgatewaysthatcreateasenseofplaceandhelpguestsexploretheareawhetherbycar,bybicycle,oronfoot.-Addingcolorandvibrancytothedistrictbyfundingbanners,holidaylightingandpublicart.BIDASSESSMENTMETHODANDBUDGETTheBIDwillutilizeanassessmentmethodthatisbaseduponlinearfrontageofapropertyonCollegeAvenueandFoothillsParkwaywithintheBIDboundary.Theassessmentwillbe$10perlinearfoot,annually.Onlycommercially-assessedpropertieswillbeincluded.TheBIDwillraiseapproximately$160,000.Additionally,theBIDwillhavetheabilitytoraisetheassessmentannuallynottoexceedtheConsumerPriceIndexforallUrbanConsumers(CPI-U)fortheDenver-Boulder-Greeley,Coloradometropolitanarea.ThisdecisionwillbeatthediscretionoftheBIDboard.BringinginrevenueandcontributionsinadditiontotheBIDassessmentwillincreaseimpactandhelptheorganizationtobestleverageinvestmentsintoMidtown.Tothatend,theBIDwillworktoprocuresupportingfundingfromtheCityofFortCollinsaswellasgrants,donations,sponsorships,memberships,fee-for-serviceprojects,crowdsourcingandpartnershipsontopoftheBIDspecialassessment.TheBIDBoard,withCityapproval,woulddeterminetheannualoperatingbudgeteachyearofBIDoperations,basedupontheprioritiessetoutinthisplan.Propertiesadjacentto,butnotwithintheBIDboundaries,mayelecttoparticipateintheBID.Uponrequest,theBIDwouldprovidetechnicalassistancetohelp.Todoso,theownersofsuchpropertieswouldberequiredtofileawrittenpetitionwiththeCityofFortCollins,requestingthattheirpropertybeincludedintheBID.Thepetitionshallbeaccompaniedbyadepositofmoneysufficienttopayallcostsoftheinclusionorexclusionproceedings.Publicnoticewillbegiven,apublichearingwillbeheldandanordinancemaybeadoptedbyFortCollinsCityCouncil.ThedeterminationofassessmentforpropertiesjoiningtheBIDwhichdonothavefrontageoneitherCollegeAvenueorFoothillsParkwayshallbeassessedthesamefrontagerateastherestoftheBIDfortheirparticularfrontageonthestreettheyarelocated.3
