HomeMy WebLinkAbout104 - 10/18/2022 - AUTHORIZING THECONVEYANCE OF A PERMANENT, NONEXCLUSIVE STORMWATER DRAINAGE EASEMENT ON REDTAIL GROVEORDINANCENO.104,2022OFTHECOUNCILOFTHECITYOFFORTCOLLINSAUTHORIZINGTHECONVEYANCEOFAPERMANENT,NONEXCLUSIVESTORMWATERDRAINAGEEASEMENTONREDTAILGROVENATURALAREATOWWWPROPERTIES,LLCWHEREAS,theCityistheownerofrealpropertylocatedsouthofHarmonyRoadalongSouthCollegeAvenueknownasRedtailGroveNaturalArea(the“CityProperty”);andWHEREAS,WWWProperties,LLC(“WWW”)ownspropertysouthoftheCityProperty,at5811SouthCollegeAvenue,whichisthesiteoftheFortCollinsNissandealership(the“WWWProperty”);andWHEREAS,theCityisintheprocessofreviewingaFinalDevelopmentPlanfortheWWWPropertythatwouldincludetakingdowntheexistingbuildingonthepropertyandreplacingitwithanewKiadealershipandanewNissandealership;andWHEREAS,fortheproposeddevelopmenttobeapproved,WWWmustacquireanyneededeasementstomanagestormwaterdrainageissuesassociatedwithincreaseddevelopmentonitsproperty;andWHEREAS,WWWandCitystaffconsideredfivealternativesformanagingstormwateroutfallandconcludedthatthepreferredoptionistocollectstormwaterinundergroundwaterqualitydetentionfacilitiesontheWWWpropertyandthendirectitinaneasementoverahistoricnaturaldrainageswaleondownstreamproperties,includingtheCityProperty,toFossilCreek;andWHEREAS,thisoptionbenefitstheCityPropertybyfilteringstormwaterrunoffforwaterqualitybeforeitisreleasedandreducingtheovertoppingoftheFossilCreekTrailontheCityPropertyduringsignificantstormevents;andWHEREAS,thelocationoftheproposedstormwatereasementisshownanddescribedonExhibit“A”,attachedandincorporatedhereinbyreference(the“Easement”):andWHEREAS,WWWwouldpaytheCityfairmarketvalueofS1,270fortheEasement.plusa$3,000applicationfee,anda$3,800mitigationfeethatNaturalAreaswillusetoplantvegetationontheCityPropertytomitigateerosionfromstormwaterdrainage;andWHEREAS,theEasementwouldbenonexclusiveandwouldnotgrantWWWanyrighttoinstallanynewimprovementsontheCityProperty;andWHEREAS,Section23-111(a)oftheCityCodeauthorizestheCitCounciltosell,conveyorotherwisedisposeofanyinterestsinrealpropertyownedbytheCity,providedtheCityCouncilfirstfinds,byordinance,thatsuchsaleorotherdispositionisinthebestinterestsoftheCity.NOW,THEREFORE,BEITORDAINEDBYTHECOUNCILOFTHECITYOFFORTCOLLINSasfollows:—1—
