HomeMy WebLinkAbout2022-107-10/18/2022-ADOPTING FINDINGS OF FACT SUPPORTING THE HISTORIC PRESERVATION COMMISSION'S DECISION TO DENY PROPOSERESOLUTION2022-107OFTHECOUNCILOFTHECITYOFFORTCOLLINSADOPTINGFINDINGSOFFACTSUPPORTINGTHEHISTORICPRESERVATIONCOMMISSION’SDECISIONTODENYPROPOSEDWINDOWALTERATIONSTOTHELANDMARKEDPROPERTYLOCATEDAT1306W.MOUNTAINAVENUEANDDENYINGTHEAPPEALWHEREAS,thepropertylocatedat1306.W.MountainAvenuewasdesignatedasaFortCollinslandmarkin2014astheWilliamandVioletJacksonProperty(the“Property”);andWHEREAS,pursuanttoCityCodeSection14-54,proposedalterationsofaFortCollinslandmarkmustmeettheUnitedStatesSecretaryoftheInteriorStandardsforRehabilitationofhistoricproperties(the“Standards”)inorderfortheHPCtoapprovesuchalterations;andWHEREAS,onJuly20,2022,theFortCollinsHistoricPreservationCommission(the“HPC”)conductedapublichearingtoreviewproposedalterationstothePropertyandatthehearing,theHPCona4-2voteapprovedcertainalterationsbutdeniedproposedalterationstoremoveanexistingwindowinthenorthwestbedroomandinstalltwonewwindows(the“WindowAlterations)becausetheWindowAlterationsdidnotmeetStandards#2and#5;andWHEREAS,pursuanttoCityCodeSections2-46and2-49,anoticeofappealwastimelyfiled(the“Appeal”)andtheparty(the“Appellant”)filingtheAppealisthePropertyowner’srepresentativeandisaparty-in-interesteligibletofileanappeal;andWHEREAS,theAppealallegedthattheHPCfailedtoconductafairhearingbecauseCommissionerMegDunnwasbiasedagainsttheAppelLantbyreasonofaconflictofinterestorotherclosebusiness,personalorsocialrelationshipthatinterferedwithherindependenceofjudgmentasadecisionmaker;andWHEREAS,theAppealfurtherallegedthattheHPCfailedtoproperlyinterpretandapplyCityCodeSection14-53,specificallythattheHPCimproperlyinterpretedandappliedStandards#2and#5andtheSecretaryofInterior’stechnicalbulletinITSNumber14whentheHPCdeniedtheWindowAlterations;andWHEREAS,whiletheAppealallegationoffailuretoproperlyinterpretandapplyreferstoCityCodeSection14-53.thecorrectCityCodeSectionis14-54and,becauseitisclearfromtheAppealthatwaswhattheAppellantintended.CouncilfindsthatitisreasonabletoconsidertheAppealasthoughitreferencedCityCodeSection14-54:andWHEREAS.theCityCouncilfindsthatbaseduponCitystafftestimonyattheAppeal1-learingthattheSecretaryofInterior’stechnicalbulletinITSNumber14isintendedtoprovideguidanceintheapplicationoftheStandardsbutisnotitselfaCityCode.LandUseCode,orCharterprovisionsubjecttoappealpursuanttoCityCodeSection2-48:andWHEREAS,onOctober4,2022,theCityCouncil,afternoticegiveninaccordancewithCityCodeSection2-52,heldapublichearing(the“AppealHearing’)pursuanttoCityCode Section2-54toconsidertheallegationsraisedintheAppealatwhichhearingtheCityCouncilconsideredtherecordonappeal,andtestimonyfromCityStaff,theAppellantandProperwowner.andLauraBailey.aparty-in-interestopposedtotheAppeal;andWHEREAS.afterdiscussion,theCityCouncilfoundandconcludedbasedontheevidenceintherecordandpresentedattheAppealHearing,thattheHPCconductedafairhearingbecausetheAppellantdidnotestablishwithcompetentevidenceintherecordthatCommissionerDunnwasbiasedagainsttheAppellant,andthereiscompetentevidenceintherecordindicatingthatCommissionerDuimappliedtheappropriatelegalstandardsinareasonedandunbiasedmaimer:andWHEREAS,theCityCouncilfurtherfoundandconcludedbasedontheevidenceintherecordandpresentedattheCityCouncilAppealHearing,thattheHPCproperlyinterpretedandappliedCityCodeSection14-54withregardstoStandards#2and#5becausetheAppellantdidnotestablishwithcompetentevidencethattheHPCfailedtodosoand,thereiscompetentevidenceintherecordindicatingareasonedandreasonableHPCdiscussionandapplicationofStandards#2and#5totheWindowAlterationsinlightofthepurposeofpreservingthehistoricnatureoftheProperty;andWHEREAS.CityCodeSection2-56(c)providesthatnolaterthanthedateofitsnextregularmeetingafterthehearingofanappeal,CityCouncilshalladopt.byresolution,findingsoffactinsupportofitsdecisiononsuchappeal.NOW,THEREFORE,BEITRESOLVEDBYTHECOUNCILOFTHECITYOFFORTCOLLINSthat,pursuanttoSection2-56(c)oftheCityCode,theCityCouncilherebymakesandadoptsthefollowingfindingsoffactandconclusions:1.ThattheCityCouncilherebymakesandadoptsthedeterminationsandfindingscontainedintherecitalssetforthabove.2.That,basedontheevidenceintherecordandpresentedattheCityCouncilAppealHearing,theCouncilfindsthattheHPCconductedafairhearingbecauseCommissionerMegDunnwasnotbiasedagainsttheAppellantforthereasonssetforthintherecitalsabove.3.That,basedontheevidenceintherecordandpresentedattheCityCouncilAppealHearing,theCouncilfindsthattheHPCproperlyinterpretedandappliedCityCodeSection14-54regardingStandards#2and#5forthereasonssetforthintherecitalsabove.4.That,basedontheevidenceintherecordandpresentedattheAppealHearing,theAppealiswithoutmeritandisdeniedinitsentirety.5.ThatadoptionofthisResolutionshallconstitutethefinalactionoftheCityCouncilinaccordancewithCityCodeSection2-56(c).
