Home My WebLink About2022-099-09/20/2022-SETTING FORTH FINDINGS OF FACT AND DETERMINATIONS REGARDING THE PEAKVIEW ANNEXATION NO. 1RESOLUTION2022-099OFTHECOUNCILOFTHECITYOFFORTCOLLINSSETTINGFORTHFINDINGSOFFACTANDDETERMINATIONSREGARDINGTHEPEAKVIEWANNEXATIONNO.1WHEREAS,pursuanttoResolution2022-082,annexationproceedingswereinitiatedbytheCityCouncilforpropertytobeknownasthePeakviewAnnexationNo.I(the“Property”);andWHEREAS,followingnoticegivenasrequiredbylaw,theCityCouncilheldahearingonsaidannexationonSeptember20,2022.NOW,THEREFORE,BEITRESOLVEDBYTHECOUNCILOFTHECITYOFFORTCOLLINSasfollows:Section1.ThattheCityCouncilherebymakesandadoptsthedeterminationsandfindingscontainedintherecitalssetforthabove.Section2.ThattheCityCouncilherebyfindsthatthepetitionforannexationofthePropertycomplieswiththeMunicipalAnnexationAct(the“Act”),ColoradoRevisedStatutesSection31-12-101,etseq.Section3.ThattheCityCouncilherebyfindsthatthereisatleastone-sixth(1/6)contiguitybetweentheCityandthePropertyproposedtobeannexed;thatacommunityofinterestexistsbetweenthePropertyproposedtobeannexedintotheCity;thatsaidPropertyisurbanorwillbeurbanizedinthenearfuture;andthatthePropertyisintegratedwithoriscapableofbeingintegratedwiththeCity.Section4.ThattheCityCouncilfurtherdeterminesthattheapplicablepartsoftheActhavebeenmet,thatanelectionisnotrequiredundertheAct,andthattherearenoothertermsandconditionstobeimposeduponsaidannexation.Section5.ThattheCityCouncilfurtherfindsthatnoticewasdulygiven,andahearingwasheldregardingtheannexationinaccordancewiththeAct.Section6.ThattheCityCouncilconcludesthatthePropertyiseligibleforannexationtotheCityandshouldbesoannexed.
