HomeMy WebLinkAbout096 - 09/20/2022 - CONDITIONALLY VACATING A PORTION OF COLEMAN STREET RIGHT-OF-WAYORDINANCENO.096,2022OFTHECOUNCILOFTHECITYOFFORTCOLLINSCONDITIONALLYVACAT[NGAPORTIONOFCOLEMANSTREETRIGHT-OF-WAYWHEREAS,thepreviouslyapprovedEastridgeSecondFilingsubdivisionplatdedicatedColemanStreetinternaltothesubdivisionasapublicstreetright-of-way;andWHEREAS,thedeveloperoftheMulberry&GreenfieldsPlannedUnitDevelopment,MulberryDevelopment,LLC,(the“Developer”)locatedeastofandadjacenttoEastridgeSecondFilinghasrequestedthattheportionofColemanStreeteastofFairchildStreetbevacatedasdepictedonExhibit“A”attachedheretoandincorporatedherein(suchportionhereinafterreferredtoasthe“VacationArea”);andWHEREAS,theVacationAreaisadead-endstreetstuboriginallyintendedtobeextendedupondevelopmentofthelandtotheeast;andWHEREAS,theDeveloperhasstatedthatextendingColemanStreeteastofFairchildStreetintotheMulberry&GreenfieldsPlannedUnitDevelopmentisnotnecessaryandproposesthatthecurrentstreetstubberemovedandlandscapinginstalledwithintheVacationArea;andWHEREAS,thedeveloperofEastRidgeSecondFilinghassubmittedaminoramendment,MA220027,toamendthesiteplantoallowremovalofthestreetstubwithintheVacationAreaandtoinstalllandscapinginitsplace;andWHEREAS,theCityEngineerhasroutedthevacationrequesttopotentiallyaffectedutilityagencies,Citystaff,emergencyserviceprovidersandaffectedpropertyownersinthevicinityoftheVacationAreaandnoobjectiontotheproposedvacationhasbeenreceived;andWHEREAS,inaccordancewithCityCodeSection23-I15,theCityEngineerrecommendedconditionalapprovalofthisvacationtothePlanning,DevelopmentandTransportationDirector,andtheDirectorrecommendstoCouncilthattherequestforvacationbeapprovedwiththeconditionssetforthintheOrdinance;andWHEREAS,therightoftheresidentsoftheCityofFortCollinswillnotbeprejudicedorinjuredbythevacationofsaidstreetrights-of-way.NOW,THEREFORE,BEITORDAINEDBYTHECOUNCILOFTHECITYOFFORTCOLLINSasfollows:Section1.ThattheCityCouncilherebymakesandadoptsthedeterminationsandfindingscontainedintherecitalssetforthabove.Section2.ThattheCityCouncilherebyfindsanddeterminesthat: (1)TheVacationAreamoreparticularlydescribedonExhibit“A”attachedheretoandincorporatedhereinisnolongerneededforroadright-of-waypurposesandthatitisinthepublicinteresttovacatetheVacationAreaprovidedcertainconditionsasstatedinSection3belowaremet;and(2)UponvacationoftheVacationArea,theCityherebyreservesanon-exclusiveblanketeasementforaccessandutilitieswithintheVacationArea(the“ReservedCityEasement”);and(3)TitletotheVacationAreashallvest,subjecttotheReservedCityEasement,inaccordancewithSection43-2-302,C.R.S.Section3.ThisvacationshallnottakeeffectuntilthisOrdinanceisrecordedwiththeLarimerCountyClerkandRecorderandthisOrdinanceshallnotberecordeduntilthefollowingconditionshavebeenmet:(I)AttheDeveloper’ssoleexpense,theDevelopermustdemolishtheexistingstreetimprovementsintheVacationAreatotheCity’ssatisfactionafterprovidingabondwiththeCityasobligeefor125%oftheestimatedcosttorestorethedemolishedstreetimprovementswithintheVacationAreashouldthisOrdinancebecomenullandvoidasstatedinSection4below,andsuchbondshallbereleaseduponrecordingofthisOrdinance(2)TheEastRidgeSecondFiling--ROWMinorAmendment,MA220027,mustmeetallapplicableLandUseCoderequirementsandreceiveCityapproval;(3)TheMuLberryMetropolitanDistrictNo.3(“MetropolitanDistrict”)mustenterintoanintergovernmentalagreementacceptabletotheCityinwhichtheMetropolitanDistrictagreesto:(a)IfownershipoftheVacationAreadoesnotvestintheMetropolitanDistrictunderSection43-2-302,C.R.S.,obtainownershipoftheVacationAreaimmediatelyaftervacation,subjecttotheReservedCityEasement;(b)ProvideabondwiththeCityastheobligeefor125%oftheestimatedvalueofthelandscapeimprovementswithintheVacationArea,assuchimprovementsaredescribedintheapprovedMA220027minoramendment,toguaranteecompletionofsuchimprovements;and(c)MaintaintheVacationAreainperpetuitypursuanttotheCity’sapprovedMA220027minoramendmentlandscapeplan,andanysubsequentamendments,attheMetropolitanDistrict’ssoleexpense.(4)TheCityManagerisauthorizedtosigntheintergovernmentalagreementreferencedin(3)aboveandanysubsequentamendmentofsuchagreement. Section4.IfthisOrdinanceisnotrecordedwithinthreeyearsofthedateofsecondreadingofthisOrdinance,thenthisOrdinanceshallbecomenullandvoid.ShouldthisOrdinancebecomenullandvoidbuttheexistingroadimprovementswithintheVacationAreahavebeendemolishedpursuanttoSection3,Subsection(1)above,theDevelopermustrestoretheroadimprovementswithinone-hundredandtwentydaysofthisOrdinancebecomingnullandvoid,orsuchfurthertimeastheCityManagermaygrantinwritingtheirreasonablediscretiontorestoretheroadimprovementsinconsiderationofthewinterseasonorotherconstructionlimitations,afterwhichtheCitymaycalluponthebondtorestoresuchroadimprovements.CityClerkIntroduced,consideredfavorablyonfirstreading,andorderedpublishedthis6thdayofSeptember,A.D.2022,andtobepresentedforfinalpassageonthe20thdayofSeptember,A.D.2022ATTEST:4Passedandadoptedonfinalreadingthis20thdayofSeber,A.D.ATTEST: VACATION LEGAL DESCRIPTION COLEMAN STREET RIGHT OF WAY VACATION EAST OF FAIRCHILD STREET, EAST RIDGE SECOND FILING PLAT AS RECORDED AT RECEPTION NUMBER 20160047573 IN THE LARIMER COUNTY CLERK AND RECORDER'S OFFICE, LOCATED IN THE NORTHEAST QUARTER OF SECTION 8, TOWNSHIP 7 NORTH, RANGE 68 WEST OF THE SIXTH (6TH)PRINCIPAL MERIDIAN IN THE CITY OF FT COLLINS, COUNTY OF LARIMER, STATE OF COLORADO.
