HomeMy WebLinkAbout090 - 09/20/2022 - AUTHORIZING THE CONVEYANCE OF AN EMERGENCY ACCESS EASEMENT TO POUDRE FIRE AUTHORITY ON CITY-OWNED PRORDINANCENO.090,2022OFTHECOUNCILOFTHECITYOFFORTCOLLINSAUTHORIZINGTHECONVEYANCEOFANEMERGENCYACCESSEASEMENTTOPOUDREFIREAUTHORITYONCITY-OWNEDPROPERTYAT430NORTHCOLLEGEAVENUEWHEREAS,theCityistheownerofrealpropertylocatedat430NorthCollegeAvenue,whichisthesiteoftheOldPowerPlant(the“Property”);andWHEREAS,thePropertyisownedbytheCity’selectricutilitybutisnolongerneeded,exceptincidentally,forutilitypurposes;andWHEREAS,sinceFebruary2012theCityhasleasedthePropertytotheColoradoStateUniversityResearchFoundation(“CSURF”)foruseastheColoradoStateUniversity(“CSU”)EnginesandEnergyConversionLaboratory(the“EnginesLab”),alsoknownasthePowerhouseEnergyCampus,pursuanttoOrdinanceNo.183,2011;andWHEREAS,priorto2012,CSUhadleasedaportionofthePropertyfortheEnginesLabsince1994;andWHEREAS,CSURFhassubmittedplanstotheCitytomakeimprovementstothePropertytosupportahydrogenfuelingstationandturbinegenerator;andWHEREAS,asaconditionofapprovalofCSURF’splans,theCity,aspropertyowner,mustconveyanemergencyaccesseasementtoPoudreFireAuthority(PFA)toprovideaccessforfiretrucksandotheremergencyequipment(the“Easement”);andWHEREAS,thelocationoftheproposedEasement,whichisoveranexistingdriveway,isshownanddescribedonExhibit“A”,attachedandincorporatedhereinbyreference;andWHEREAS,Section23-111oftheCityCodeauthorizestheCityCounciltosell,conveyorotherwisedisposeofanyinterestinrealpropertyownedbytheCity,providedthattheCityCouncilfirstfinds,byordinance,thatsuchsaleorotherdispositionisinthebestinterestsoftheCityand,withrespecttopropertywhichispartoftheCity’sutilitysystems,thatthedispositionwillnotmateriallyimpairtheviabilityoftheparticularutilitysystemasawholeandwillbeforthebenefitofthecitizensoftheCity;andWHEREAS,asconsiderationfortheCity’sconveyanceoftheEasementCSURFhasagreedtopaytheCityanadministrativefeeof$500andassumeresponsibilityformaintainingthesurfaceoftheEasement;andWHEREAS,CitystaffisrecommendingthattheCitynotchargeCSURForPFAfullfairmarketvaluefortheEasementastheconveyanceservesabonafidepublicpurposeunderSection23-114oftheCityCodebecause: (1)TheuseoftheEasementforemergencyaccessbyPFA,andCSURF’scontinueduseofthePropertyforresearchanddevelopmentofalternateenergysolutions,promoteshealth,safetyorgeneralwelfareandbenefitsasignificantsegmentofthecitizensofFortCollins;(2)TheusetowhichthePropertywillbeputsupportsoneormoreoftheCityCouncilsgoals,adoptedpolicies,projectsorplansbycontinuingthesupporttheCityCouncilhaspreviouslyshownfortheEnginesLabthroughtheminimalrent($25peryear)theCitychargesCSURFunderthe2012lease;(3)ThefinancialsupportprovidedbytheCitythroughthebelow-marketconveyanceoftheEasementwillbeleveragedwithotherffindingorassistancefromCSURF;(4)ConveyanceoftheEasementwillnotresultinanydirectfinancialbenefittoanyprivatepersonorentity,excepttotheextentsuchbenefitisonlyanincidentalconsequenceandisnotsubstantialrelativetothepublicpurposebeingserved;and(5)ConveyingtheEasementforlessthanfairmarketvaluewillnotinterferewithcurrentCityprojectsorworkprograms,hinderworkloadschedulesordivertresourcesneededforprimaryCityfunctionsorresponsibilities.NOW,THEREFORE,BEITORDAINEDBYTHECOUNCILOFTHECITYOFFORTCOLLINSasfollows:Section1.ThattheCityCouncilherebymakesandadoptsthedeterminationsandfindingscontainedintherecitalssetforthabove.Section2.ThattheCityCouncilherebyfindsthattheCity’sconveyanceoftheEasementtoPFAasdescribedhereinisinthebestinterestsoftheCity,willnotimpairtheviabilityoftheelectricutilitysystemasawhole,andwillbeforthebenefitofthecitizensoftheCity.Section3.ThattheCityCouncilherebyauthorizestheMayortoexecutesuchdocumentsasarenecessarytoconveytheEasementtoPFAontermsandconditionsconsistentwiththisOrdinance,togetherwithsuchtermsandconditionsastheCityManager,inconsultationwiththeCityAttorney,determinesarenecessaryorappropriatetoprotecttheinterestsoftheCity,including,butnotlimitedto,anynecessarychangestothelegaldescriptionoftheEasement,aslongassuchchangesdonotmateriallyincreasethesizeorchangethecharacteroftheinteresttobeconveyed.
