HomeMy WebLinkAbout2022-020-01/18/2022-APPROVING AN ART PROJECT FOR THE VINE AND LEMAY PROJECT AND APPROVING EXPENDITURES FROM THE ART IN PPostponed Indefinitely 1/18/22 RESOLUTION 2022-020 OF THE COUNCIL OF THE CITY OF FORT COLLINS APPROVING AN ART PROJECT FOR THE VINE & LEMAY PROJECT AND APPROVING EXPENDITURES FROM THE ART IN PUBLIC PLACES RESERVE ACCOUNT IN THE CULTURAL SERVICES AND FACILITIES FUND AND THE PROJECT BUDGET TO COMMISSION AN ARTIST TO CREATE THE ART PROJECT PURSUANT TO THE ART IN PUBLIC PLACES PROGRAM WHEREAS, the City is in the process of completing the Lemay Avenue bridge over Vine Drive (the “Project”); and WHEREAS, pursuant to Sections 23-303 and 23-304 of the City Code, one percent of funds appropriated for the Project was set aside in the Art in Public Places Reserve Account in the Cultural Services and Facilities Fund for use in the acquisition and installation of works of art in accordance with the Art in Public Places Guidelines adopted by the City Council in Ordinance No. 047, 1998 (the “Guidelines”); and WHEREAS, Artist Joshua Wiener was selected from a Request for Qualifications process to complete an art project to integrate art into the Lemay Avenue bridge fencing and along the streetscape for the Project (the “Art Project”); and WHEREAS, the Art Project includes ten three-dimensional sculptures made of aluminum and steel and art designed for the bridge pedestrian fence panels; and WHEREAS, the Art in Public Places Board (the “Board”) approved the design concept of the Art Project and recommended Council approval at the Board’s December 15, 2021, regular meeting; and WHEREAS, the funds for the Art Project have been appropriated in the Art in Public Places Reserve Account in the Cultural Services and Facilities Fund; and WHEREAS, the estimated cost to complete the Art Project, including design, engineering, materials, signage, fabrication, delivery, installation, and contingency is $193,578; and WHEREAS, $160,000 of the funds for the Art Project is available in the Art in Public Places Reserve Account in the Cultural Services and Facilities fund, while the remaining $33,578, to be spent for the art on the bridge fencing panels, will be paid by the Project and has been appropriated in the Project budget; and WHEREAS, City Code Section 23-308 requires that the Board’s recommendation concerning the use of funds for the Art Project be presented for City Council review and approval as the cost of the Art Project exceeds $30,000. NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF FORT COLLINS as follows: Postponed Indefinitely 1/18/22 Section 1. That the City Council hereby makes and adopts the determinations and findings contained in the recitals above. Section 2. That the City Council hereby approves the use of previously appropriated funds in an amount not to exceed ONE HUNDRED SIXTY THOUSAND DOLLARS ($160,000) from the Art in Public Places Reserve Account in the Cultural Services and Facilities Fund and THIRTY THREE THOUSAND FIVE HUNDRED SEVENTY EIGHT DOLLARS ($33,578) from the Project budget for the Art Project described herein for inclusion in the Vine & Lemay Project, the conceptual design for which was reviewed and approved by the Art in Public Places Board on December 15, 2021.
