HomeMy WebLinkAbout1982-117-09/07/1982-FINDING THAT THE PREMISES AT 1212 BAKER STREET ARE BEING MAINTAINED IN AN OFFENSIVE CONDITION AND DI RESOLUTION 82-117 OF THE COUNCIL OF THE CITY OF FORT COLLINS FINDING THAT THE PREMISES AT 1212 BAKEP STREET ARE BEING MAINTAINED IN AN OFFENSIVE CONDITION AND DIRECTING THE CITY ENGINEER TO ABATE THE OFFENSIVE CONDITIONS WHEREAS, in accordance with §79-1 of the Code of the City of Fort Collins, the City Engineer had determined that the premises at 1212 Baker Street are being maintained in an offensive condition and has caused a notice of such condition to be given to Clyde D Baker, hereinafter re- ferred to as "owner" of said property, ordering said premises to be put in proper condition, and WHEREAS, Clyde D Baker, the owner/occupant of said premises has failed or refused to fully comply with the order of the City Engineer within the time given, and WHEREAS, the owner has been duly notified of the present proceedings of the Council of the City of Fort Collins with regard to the above re- ferenced matter, and WHEREAS, the Council finds that the conditions existing at 1212 Baker Street are offensive and constitute a nuisance NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF FORT COLLINS that Clyde D Baker is hereby ordered to remedy the offensive conditions existent at 1212 Baker Street in the City of Fort Collins, Colorado, and thereby abate the nuisance which the Council of the City of Fort Collins has found to exist upon said premises on or before 8 AM, September 14, 1982, in the following particulars 1 Removal of lumber, wooden pallets, and other scraps of wood unless same be sawn into appropriate lengths and stacked neatly for future utilization as fire wood 2 Removal of carpet, cloth, rags, and other textiles from the yard or street adjacent to the property 3 Removal of all wire, metal or other miscellaneous materials unless part of a usable piece of household equipment, furniture, or other common household appurtenance In the event that said owner shall have failed to remedy the offensive condition and abate the nuisance at the above stated premises on or before 8 AM, September 14, 1982, then the City Engineer and Director of Transpor- tation shall take immediate steps to abate said nuisance and, together with 4 the Finance Director, shall assess, in accordance with 79-1(c) of the Code of the City of Fort Collins, the expense of so doing against the lot or premises upon which said condition or nuisance has hereby been found to exist Passed and adopted at a regular meeting of the City Council held this 7th day of September, 1982 Mayor ATTEST City Clerk -2-
