OF THE COUNCIL OF THE CITY OF FORT COLLINS
AUTHORIZING THE CITY MANAGER TO ENTER INTO
AN AGREEMENT WITH GIACO ENTERPRISES FOR LEASE
OF THE "CAR BARN"
WHEREAS, the City of Fort Collins is the owner of that certain parcel
of real property upon which is located a certain building commonly known as
the "Car Barn" in the City of Fort Collins, and which parcel is legally
described as the West 170 feet of Lots 9 and 10, Block 33, of the City;
and
WHEREAS, Giaco Enterprises desires to obtain from the City a right of
first refusal to lease the above described property from the City in the
event that the City should determine to so lease said property; and
WHEREAS , the City Council has determined that it is in the best
interests of the citizens of the City that the City enter into a Right of
First Refusal Agreement, in consideration of the payment of Ten Dollars
($10.00) to the City, said Agreement to continue until August 10, 1985,
wherein Giaco Enterprises would be ranted the right of first refusal to

any acceptable lease that may be presented to the City for the purpose of
leasing the property known as the "Car Barn."
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF FORT
COLLINS that the City Manager be, and he hereby is, authorized to enter
into a Right of First Refusal Agreement with Giaco Enterprises granting
unto Giaco Enterprises the right of first refusal as against any acceptable
lease that may be presented to the City for the purpose of leasing that
property known as the "Car Barn" , which right of first refusal shall
continue until August 10, 1985, at 5:00 PM, and upon the terms and condi-
tions as are contained in said Agreement.
Passed and adopted at a regular meeting of the City Council held this
3rd day of April , A.D. 1984.
