HomeMy WebLinkAbout1993-133-09/07/1993-AMERICANS WITH DISABILITIES CARE-A-VAN INC EXCEPTION TO COMPETITIVE BID PARATRANSIT SERVICES RESOLUTION 93-133 OF THE COUNCIL OF THE CITY OF FORT COLLINS AUTHORIZING THE CITY MANAGER TO ENTER INTO A CONTRACT WITH CARE-A-VAN, INC. , FOR THE PURPOSE OF PROVIDING PARATRANSIT SERVICES TO DISABLED AND ELDERLY CITIZENS OF THE FORT COLLINS URBAN GROWTH AREA FOR THE PERIOD OF JULY 1, 1993, TO DECEMBER 31, 1993 WHEREAS, the City has contracted with Care-A-Van, Inc. , for many years to provide paratransit services for persons with disabilities and seniors and for the operation of the City's SAINT Volunteer Transportation Program; and WHEREAS, the cost of providing these services has increased beyond original expectations because of the increase in demand for services, the requirements of the Americans with Disabilities Act and increases in Care-A-Van operating expenses; and WHEREAS, the City wishes to enter into a contract with Care-A-Van, Inc. , to procure $138,122 worth of paratransit services for the period of July 1, 1993, to December 31, 1993; and WHEREAS, sufficient funds have been previously appropriated and are available for that purpose; and WHEREAS, Section 8-160(d)(1)(b) of the City Code provides that a contract for services may be awarded without competition if the Purchasing Agent determines in writing that, although there exists more than one responsible source, a competitive process cannot reasonably be used or, if used, will result in a substantially higher cost to the City, will otherwise injure the City's financial interest or will substantially impede the City's administrative functions for the delivery of services to the public; and WHEREAS, the City's Purchasing Agent has determined in writing that the contract to provide the needed paratransit services should be awarded to Care-A- Van, Inc. , without a competitive process because the use of a competitive process will substantially impede the City's administrative functions and the delivery of these services to the public; and WHEREAS, Section 8-160(d) (3) of the City Code requires the City Manager to submit all procurements under subsection (d) of such section which exceed the cost of $50,000 to the City Council in an open meeting for approval ; and WHEREAS, the City Manager has approved this procurement. NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF FORT COLLINS that the City Manager is authorized to enter into a contract with Care-A-Van, Inc. , in the amount of One Hundred Thirty-Eight Thousand One Hundred Twenty-Two Dollars ($138,122) to provide paratransit services to disabled persons and elderly citizens in the City of Fort Collins Urban Growth Area for the period of July 1, 1993, to December 31, 1993, and hereby approves the procurement of these services without the use of a competitive process.
