WHEREAS , UNION PACIFIC RAILROAD COMPANY and THE
MOUNTAIN STATES TELEPHONE AND TELEGRAPH CO'`1PANY have tenderea
to the CITY OF FORT COLLINS , COLORADO, an agreement extenaing
to and including October 8 , 1977 , the term of contract oaten
November 14 , 1952 , whereby UNION PACIFIC RAILROAD COMPANY
grants to THE MOUNTAIN STATES TELEPHONE AND TELEGRAPH COMPANY
and CITY OF FORT COLLINS , COLORADO, the right to construct,
maintain and operate a power line and a telephone wire line
on the right of way and under the scale track of the Railroad
Company 's Fort Collins Branch, Fort Collins , Colorado, said
agreement being identified as Railroad Company ' s C D No
38879-D, and
WHEREAS, the Counc_1 of the City of Fort Collins
has said propozed agreement before it and has given it careful
review and cons-Laeration , and
WHEREAS , it is considered that the best interests of
said City of Fort Collins_, Colorado will be
subserved by the acceptance of said agreement,
THEREFORE, BE IT R:,SOLVED BY THE COUNCIL OF THE
CITY OF FORT COLLINS , COLORADO
That the terms ox the agreement submitted by
Union Pacific Railroad Company as aforesaid be, and the same
are hereby, accepted in oenalf of said City,
That the mayor of said City is nereby authorized,
empowered and directed to e;ecute said agreement on behalf of
Baia City , and that the C, ty Clerk of said City is hereby
authorizea and airected to attest saia agreement ana to attach
to each du-olycate original of said agreement a certified copy
of this resolution_
