OF THE COUNCIL OF THE CITY OF FORT COLLINS
AUTHORIZING THE EXECUTION OF AN AGREEMENT
FOR THE PURCHASE OF REAL PROPERTY LOCATED
WITHIN THE CITY OF FORT COLLINS ON THE BLOCK
BOUNDED ON THE SOUTH BY MOUNTAIN AVENUE , ON
THE WEST BY HOWES STREET, ON THE NORTH BY
LAPORTE AVENUE AND ON THE EAST BY MASON STREET
WHEREAS, the City of Fort Collins (hereinafter referred to as "City")
has heretofore purchased property in the City of Fort Collins in the block
bounded on the south by Mountain Avenue, on the west by Howes Street, on
the north by LaPorte Avenue and on the east by Mason Street (hereinafter
referred to as the "Block 31") , and
WHEREAS, 256 West Mountain Associates, a partnership, owner of a
parcel of land located within the aforementioned Block 31 desires to convey
said parcel to the City, in fee simple, absolute, free and clear of all
liens and encumbrances, in consideration for the payment of a purchase
price of $162,600 00, and
WHEREAS , the purchase of said real property, upon the terms and
conditions as herein stated, and as may be more expressly provided in the
agreement between the City and 256 West Mountain Associates, a partnership,
is hereby deemed by the Council of the City of Fort Collins to be in the
best interests of the citizens of the City
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF FORT
COLLINS as follows
1 That the Mayor be, and is hereby, authorized and empowered to
enter into an agreement with 256 West Mountain Associates, a partnership,
whereby the City shall
a Purchase a parcel of land legally described as
The South 5 feet of Lot 27, all of Lot 28 and the
North 10 feet of Lot 29 in Block 31, in the City of
Fort Collins, ALSO, the South 15 feet of Lot 29 and
all of Lot 30 , in Block 31 , in the City of Fort
Collins, Larimer County, Colorado
b Pay as consideration for the purchase of said property the sum
of $162,600 00 to be paid at the time of closing
c Receive title for said property in fee simple, absolute, free
and clear of all liens and encumbrances
Passed and adopted at a regular meeting of the Council of the City of
Fort Collins held this 21st day of September , 198
