OF THE COUNCIL OF THE CITY OF FORT COLLINS
AUTHORIZING THE EXECUTION OF AN AGREEMENT
BETWEEN THE CITY AND
POUDRE VALLEY RURAL ELECTRIC ASSOCIATION, INC
WHEREAS, Poudre Valley Rural Electric Association, Inc , (REA) pro-
vides electrical energy to consumers located within areas in close prox-
imity to the City' s boundaries, and
WHEREAS, the City has expanded, or will expand, by annexation its
territory into that area presently served by REA, and
WHEREAS, the said expansion of the City into territory served by REA
has resulted in conflicts between the City and REA as to the appropriate
entity to provide electrical energy to consumers located in those areas so
annexed or to be annexed by the City, and
WHEREAS, the City and REA have negotiated a territorial service
agreement for the purpose of avoiding duplication of service facilities,
establishing a working relationship and preserving an option for the City
to serve electric consumers within the City limits as they presently exist
or as they may exist in the future, and
WHEREAS, the Council of the City of Fort Collins has determined that
the said territorial service agreement is in the best interests of the
citizens of hte City
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF FORT
COLLINS, that the Mayor be, and he hereby is, authorized, on behalf of the
City, to enter into an intergovernmental agreement with the Poudre Valley
Rural Electric Association, Inc for the purpose of avoiding duplication
of service facilities, establishing a working relationship and preserving
the option of the City to serve electric consumers within the City limits
as they presently exist or may exist in the future
Passed and adopted at a regular meeting of the Council of the City of
Fort Collins this 6th day of April , 1982
