OF THE COUNCIL OF THE CITY OF FORT COLLINS
AUTHORIZING THE CITY MANAGER TO ENTER INTO
A CONSTRUCTION MANAGEMENT AGREEMENT WITH REID BURTON
CONSTRUCTION COMPANY, INC. FOR SERVICES IN CONNECTION
WITH THE DESIGN AND CONSTRUCTION OF THE INDOOR POOL/ICE ARENA
WHEREAS, on May 1, 1984, the citizens of Fort Collins passed a
quarter-cent sales tax for five years for the design and construction of an
indoor pool/ice arena; and
WHEREAS, Reid Burton Construction Company, Inc. was the firm selected
in 1979, using the City 's standard selection process to perform the
construction management services for this project; and
WHEREAS, Reid Burton Construction Company, Inc. has many years of
excellent local experience in the construction industry and the firm is
composed of the same personnel which worked on the Indoor Pool/Ice Arena
project in 1979; and
WHEREAS, the City has previously entered into an Interim Agreement
with Reid Burton Construction Company, Inc. relating to the project which
provided that the parties would negotiate a final construction manager
agreement; and
WHEREAS, this project will be managed pursuant to the Capital Project
Management System; and
WHEREAS, it is in the best interests of the City of Fort Collins that
Reid Burton Construction Company, Inc. be selected to perform said
construction management services at this time; and
WHEREAS, Reid Burton Construction Company, Inc. proposes to perform
said services during the construction phase for a fixed fee of $350,000
which is based upon an estimated construction cost of $7.4 million; and
WHEREAS, Reid Burton Construction Company, Inc. proposes to provide
the services as outlined in the General Conditions for a not-to-exceed fee
of $664,000; and
WHEREAS, pursuant to Section 2-66 of the Code of the City of Fort
Collins, no professional services agreement in excess of $20,000 shall be
entered into until approved by the City Council in an open Council Meeting.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF FORT
COLLINS, that the City Manager be, and he hereby is, authorized to enter
into a construction manager agreement with Reid Burton Construction
Company, Inc. for services in connection with the design and construction
of the Indoor Pool/Ice Arena project involving reimbursement for the cost
of the project (including a not-to-exceed fee for General Conditions of
$664,000) and a fixed fee of $350,000 for construction management services.
Passed and adopted at a regular meeting of the Council of the City of
Fort Collins held this 21st day of May 1985.
