HomeMy WebLinkAbout1985-201-11/05/1985-AUTHORIZING THE CITY MANAGER TO ENTER INTO AN AGREEMENT WITH THE UNION PACIFIC RAILROAD COMPANY TO L RESOLUTION 85- 201 OF THE COUNCIL OF THE CITY OF FORT COLLINS AUTHORIZING THE CITY MANAGER TO ENTER INTO AN AGREEMENT WITH THE UNION PACIFIC RAILROAD COMPANY TO LICENSE THE CONSTRUCTION, MAINTENANCE AND OPERATION OF A WATER LINE UNDER A PORTION OF THE RAILROAD'S TRACK WHEREAS, it is necessary for the City of Fort Collins to construct a water line to the Anheuser-Busch brewery site; and WHEREAS, a section of this water line must be installed under a railroad track owned by the Union Pacific Railroad system; and WHEREAS, it is necessary that an agreement be executed between the City of Fort Collins and the Union Pacific Railroad Company to license the construction, maintenance and operation of the water line ; and WHEREAS, Union Pacific Railroad Company has tendered to the City of Fort Collins, State of Colorado, an agreement covering said underground water line crossing, Mile Post 26.09 (Fort Collins Branch ) at Fort Collins, Colorado; such agreement being identified in the records of the Railroad Company as its C.D. No. 46710-6; and WHEREAS, the Council has given the matter of said license agreement careful consideration; and WHEREAS, it is considered that the best interests of said City will be subserved by the acceptance of said agreement. NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF FORT COLLINS that the Mayor and City Clerk be, and they hereby are, authorized, empowered and directed to execute, and attest, an agreement, identified as C.D. No. 46710-6, with the Union Pacific Railroad Company for the construction, maintenance and operation of an underground water line which crosses the Union Pacific Railroad track at Mile Post 26.09, Fort Collins, Colorado. Passed and adopted at a regular meeting of the City Council held this 5th day of November, A.D. 1985. , , ATTEST: -City Clerk
