OF THE COUNCIL OF THE CITY OF FORT COLLINS
AUTHORIZING EXECUTION OF AN EASEMENT AGREEMENT WITH
COLORADO STATE UNIVERSITY
WHEREAS, Article II, Section 16 of the Charter of the City of Fort
Collins authorizes the execution of contracts with other governmental
agencies for the purpose of cooperative or joint activities; and
WHEREAS, it is the desire of the City and Colorado State University
that an easement agreement be executed for the purpose of installation of
water mains over and across property owned and operated by Colorado State
University; and
WHEREAS, an easement agreement has been negotiated between the City
and the University for the purpose of installation, operation and
maintenance of various water lines, and making provision for protection of
the natural environment, restoration of the easement after construction,
construction of structures over the easement, removal of access routes and
construction work areas and various provisions of conveyance; and
WHEREAS, the Council does hereby find that it is in the best interest
of the citizens of the City that the aforesaid easement agreement be
entered into.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF FORT
COLLINS that the Mayor be, and she hereby is, authorized to enter into an
easement agreement with Colorado State University for the purpose of
conveyance of easements for the construction of various water lines over
and across property owned by Colorado State University, said easements to
be conveyed to the City for and in consideration of the payment by the City
to the University of the sum of Ten Dollars ($10.00) and upon the terms and
conditions as are contained in said easement agreement.
Passed and adopted at a regular meeting of the Council of the City of
Fort Collins held this 2nd day of July , A.D. 1985.
