OF THE COUNCIL OF THE CITY OF FORT COLLINS
ESTABLISHING CERTAIN COUNCIL POLICIES AND STATING THE INTENT
OF THE COUNCIL TO REEXAMINE THE FORT COLLINS URBAN GROWTH
AREA AGREEMENT AND BOUNDARY
WHEREAS, by Resolution 88-48, the Council of the City of Fort Collins
authorized the Mayor to enter into a revised Intergovernmental Agreement (the
"Agreement") with Larimer County, Colorado, (the "County") for the purpose of
renewing the Fort Collins Urban Growth Area and for coordinating planning and
development activities within the Fort Collins area, which Agreement was executed
on September 7, 1988; and
WHEREAS, the City Council believes that the Agreement provides substantial
benefits to the citizens of the City; and
WHEREAS, the City Council further believes that the Agreement should be
reexamined to address concerns of the City Council that have recently arisen
regarding questions of urban sprawl , both within and without the boundaries of
the Fort Collins Urban Growth Area, as well as questions pertaining to the
relative stability and permanence of the existing Fort Collins Urban Growth Area
boundary; and
WHEREAS, the City Council has further determined that it is in the best
interests of the City that the Council , by this Resolution, establish certain
policies with respect to the Agreement and the boundaries of the Urban Growth
Area.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF FORT COLLINS
as follows:
Section 1 . That, except as may be required by the Municipal Annexation Act
of the State of Colorado regarding the division of land held in identical
ownership, it shall be a policy of the City that the City shall not annex
property if such property is located outside the boundaries of the Fort Collins
Urban Growth Area.
Section 2. That it shall be a policy of the City that the City shall not
extend City capital improvements, including, without limitation, street, water,
wastewater, transit, recreational amenities or any other City-operated utility
or other capital improvement beyond the boundaries of the Fort Collins Urban
Growth Area unless such extension is determined by the Council to be necessary
for the protection of the public health and safety.
Section 3. That the City Council shall attempt, through negotiation, to
obtain the cooperation of the County and all pertinent service districts to also
limit or delay the extension of those capital improvements and public services
which are within the authority of the County or such districts to provide, if
such extension would, in the judgment of the City Council , have the effect of
eroding the permanence and stability of the Urban Growth Area boundaries or
result in or encourage urban level development outside the Urban Growth Area.
Section 4. That the City shall , at the earliest opportunity, attempt to
negotiate with the County revisions to the Agreement to clarify the same and to
strengthen the understanding between the City and County as to the purpose and
administration of the Agreement.
Section 5. That the City Manager is hereby directed to enter into
negotiations to reexamine and, as necessary, modify the Agreement consistent with
the policies and intent of this Resolution.
