OF THE COUNCIL OF THE CITY OF FORT COLLINS
AUTHORIZING THE MAYOR TO EXECUTE A
QUITCLAIM DEED CONVEYING THE INTEREST OF
THE CITY OF FORT COLLINS IN THE CHAFFEE DITCH
RIGHT-OF-WAY TO COWAN CONCRETE PRODUCTS, INC.
WHEREAS, the Parks and Recreation Department has determined that the
City has a need for additional land for the construction of the Poudre
Trail at the Strauss Cabin Trailhead area due to limited space because of
the Poudre River; and
WHEREAS, Cowan Concrete Products, Inc. , the owner of the land adjacent
to the Poudre Trail , has agreed to exchange the necessary trail easements
for the City' s interest in the Chaffee Ditch right-of-way; and
WHEREAS, the Chaffee Ditch right-of-way is not used or intended to be
used for municipal purposes in the future; and
WHEREAS, it is in the best interests of the City to exchange the trail
easement for the ditch right-of-way interest.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF FORT
COLLINS that the Mayor be, and he hereby is, authorized to execute a
quitclaim deed conveying to Cowan Concrete Products, Inc. , the City's
interest in the Chaffee Ditch right-of-way.
Passed and adopted at a regular meeting of the Council of the City of
Fort Collins held this 15th day of December, A.D. 1987.
