OF THE COUNCIL OF THE CITY OF FORT COLLINS
RELATING TO HAZARDOUS MATERIALS
ROUTE DESIGNATION
WHEREAS, by the adoption of Senate Bill 156 (the "Hazardous Materials
Transportation Act of 1987") , the Colorado General Assembly has empowered
the Colorado State Patrol with sole authority to designate which public
roads in the state shall be used and which shall not be used by motor
vehicles transporting hazardous materials; and
WHEREAS, the Colorado State Patrol is required to exercise such
authority only after consultation with local governmental authorities; and
WHEREAS, on or before July 1, 1988, petitions for route designation
may be submitted to the Patrol ; and
WHEREAS, Section 43-6-302(9) , C.R.S. , states that the City may request
the State Department of Highways to submit a petition to the Patrol for a
route designation on any highway maintained by the state within the
jurisdiction of the City; and
WHEREAS, Section 11-2 of the Code of the City of Fort Collins
describes the legislative intent behind the chapter relating to hazardous
materials transportation and states that it is the declared purpose of that
chapter to prohibit, to the extent permitted by law, the transportation of
hazardous and radioactive materials by motor vehicle within the City except
for the purpose of making pickups and/or deliveries within the City; and
WHEREAS, in furtherance of such purpose, the City Council has
determined that, in order to preserve the public health, safety and
welfare, no routes for the transportation of hazardous materials should be
designated within the City by the Patrol ; and
WHEREAS, City staff has been informed by the Patrol and the Highway
Department that the appropriate way to petition the Patrol for no route
designation within the City is to request that the State Department of
Highways petition the Patrol for hazardous material route designation on
behalf of the City, and that such designation include no route through the
City; and
WHEREAS, City Council desires that the route designation apply to the
transportation of gasoline, diesel fuel and liquified petroleum gas in
addition to other hazardous materials.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF FORT
COLLINS that the Mayor be, and he hereby is, authorized to request that the
Colorado Department of Highways petition the Colorado State Patrol for
hazardous materials route designation on behalf of the City of Fort
Collins, and that the specific route designation requested be no route
designation through the City; and, further, that gasoline, diesel fuel and
liquified petroleum gas be subject. to the route designations.
Passed and adopted at a regular meeting of the Council of the City of
Fort Collins held this 17th day of May, A.D. 1988.
