HomeMy WebLinkAbout1993-047-03/16/1993-EMPLOYEE MISCONDUCT GOLF PROFESSIONAL RESOLUTION 93-14 SOUTHRIDGE GOLF COURSE SPECIAL LEGAL COUNSEL RESOLUTION 93-47 OF THE COUNCIL OF THE CITY OF FORT COLLINS ACCEPTING THE REPORT OF SPECIAL LEGAL COUNSEL REGARDING ALLEGATIONS OF EMPLOYEE MISCONDUCT WHEREAS, by the passage of Resolution 93-14, the City Council appointed special legal counsel to investigate allegations against certain employees of the City with regard to the selection process for a new golf professional at the SouthRidge Golf Course; and WHEREAS, said special legal counsel was directed to formulate, in consultation with the City Manager, a procedure for investigating such allegations and was to compile and submit a report with findings and recommendations to the Council and the City Manager; and WHEREAS, the above-referenced investigation has been concluded by special legal counsel and a report pertaining thereto has been submitted to the City Manager, and City Council with certain findings and recommendations; and WHEREAS, the City Manager has reviewed the Report and the recommendations contained therein and has conducted such additional investigation as has been recommended by special legal counsel ; and WHEREAS, the City Manager, upon such further investigation, has determined that no personnel policies of the City have been violated by any of the employees referred to in the Report; and WHEREAS, the City Manger has reviewed the results of the investigation with the employees involved and provided guidance for improving such future processes; and WHEREAS, all employees referenced in the Report have consented to the public disclosure of the Report; and WHEREAS, the seven (7) Golf Board members involved in the selection process have received copies of the Report and had an opportunity to communicate their willingness to have it released to the public. NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF FORT COLLINS as follows: Section 1 . That the Report is hereby received, accepted and approved by the Council . Section 2. That the Report shall be made available for public inspection upon request according to the provisions of the Colorado Public Records Act. Section 3. That the City Manager be directed to work with staff and the Golf Board to improve the golf professional selection process. Section 4. To the extent that the Report describes events occurring during a Golf Advisory Board executive session, it is the intent of the Council to limit public disclosure of executive session events to only those matters which are described in the Report. Those described events are, in the opinion of the Council , relevant to the investigation of allegations of employee misconduct, the disclosure of which is in the public interest and in the best interest of the City of Fort Collins. Section 5. In the opinion of the City Council , public disclosure of the Report will not, at the time of disclosure, injure the financial interests of the City of Fort Collins. Passed and adopted at a regular meeting of the Council of the City of Fort Collins held this 16th day of March, A.D. 1993. Mayor ATTEST: City Clerk
