ORDINANCE NO. 049, 2019
OF THE COUNCIL OF THE CITY OF FORT COLLINS
AMENDING CHAPTER 2, ARTICLE III, DIVISION 2 OF
THE CODE OF THE CITY OF FORT COLLINS REGARDING
THE AFFORDABLE HOUSING BOARD
WHEREAS, in 1993 the City Council approved Ordinance No. 084, 1993, creating the
Affordable Housing Board (the “Board”) and defining the Board’s membership and functions,
currently codified in Division 2 of Article III of Chapter 2 of the City Code; and
WHEREAS, although the activities and functions of the Board have evolved over time, the
Boards functions in the City Code have never been updated; and
WHEREAS, City staff has recommended that Section 2-83 of the City Code, defining the
functions of the Board, be amended to do the following:
Allow the Board to advise not just the City Council but also City staff on matters pertaining
to affordable housing;
Advise and make recommendations on the City’s expenditure of funds for affordable
housing;
Coordinate with other organizations and entities outside the City organization whose
actions may affect affordable housing in the community; and
WHEREAS, City staff has also recommended that Section 2-82 of the City Code, regarding
membership on the Board, be amended to add a preference for including at least one current or
former residents of affordable housing on the Board; and
WHEREAS, the proposed amendments would also recognize a change in the name of the
Community Development Block Grant Commission to the Social Investment Commission, which
the City Council is considering by separate ordinance; and
WHEREAS, at its regular meeting on March 7, 2019, the Board voted to recommend that
the City Council approve the proposed amendments to Sections 2-82 and 2-83; and
WHEREAS, the City Council finds the proposed changes reflect the Council’s intent for
the role and functions of the Board, and desires to amend the Code accordingly.
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT
COLLINS as follows:
Section 1. That the City Council hereby makes and adopts the determinations and
findings contained in the recitals set forth above.
Section 2. That Section 2-82(a) of the Code of the City of Fort Collins is hereby
amended as follows:

Sec. 2-82. - Membership; term.
(a) The Board shall consist of seven (7) members appointed by the City Council, which
members shall possess expertise in affordable housing issues, including, without limitation,
issues pertaining to development, finance, lending, charitable and low-income services and
general community services.

(c) In connection with the solicitation, consideration and appointment of members to the
Board, the City Council may consider and give preference to an applicant’s experience or
training in, or familiarity with, affordable housing issues including, without limitation,
issues pertaining to development, finance, lending, charitable and low-income services
and general community services. It is also desirable that at least one Board member be a
current or former resident of affordable housing.
Section 3. That Section 2-83 of the Code of the City of Fort Collins is hereby amended
as follows:
Sec. 2-83. Functions.
The duties and functions of the Board shall be:
(1) To advise the City Council and City staff on all matters pertaining to affordable housing
issues of concern to the City;
(2) To advise and make recommendations to City staff, the Social Investment Commission
and the City Council concerning the expenditure of City Affordable Housing Fund moneys;
(23)To aid and guide the development of City-wide affordable housing programs to address
currently existing and potential affordable housing issues;
(34) To promote citizen participation and public education on City-wide affordable housing
issues;
(45) To be aware of and coordinate with the various other City boards, and commissions
and authorities, City departments, and other organizations and entities whose actions may
affect affordable housing in the community; and
(56) To perform other such duties and functions and have other powers as provided by the
City Council.
