AN ORDINANCE AUTHORIZING THE COFSTFUCTION CF A SEWER IN
FC COLLINS SANITARY SEER r=RICT NUMBER 21.
WHEREAS, A petition has been presented to the City
Council praying for the construction of a sewer connecting
with the man-hole in the sewer at the intersection of Oak
Street and Washington Street , thence south along '';ashington
Street to the alley, Block One, Prospect Place; thence west
along the center of the alley to east side of Mack Street; and,
WHEREAS, Said petition is signed by the owners of a
majority of the frontage property abutting upon such proposed
sewer and the said sewer as prayed in said petition is necessary
for the public health:
NOW, THEREFORE, Be it ordained by the City Council
of the City of Fort Collins, Colorado:
Section 1. That an extension of the city sewer com-
mencing at the manhole on Oak Street and mashington Street ;
thence south along Washington Street to alley in Block Cne,
Prospect Place ; thence west along center of alley to east side
Ivlack Street, the same to be constructed of six- inch sewer pipe
is hereby ordered in accordance with Ordinance Number 12 of 1890,
and in accordance with the plans and specifications adopted for
the same by the City Council, October 19, 1908.
Section 2. That a committee consisting of three
aldermen 19hall be appointed by the city council, who shall have
charge of and shall supervise the construction cf said improvement,
in accordance with the provisions of Ordinance No. 19-1884.
Section 3. That the cost of said sewer extension
shall be assessed pro rata against the lots and parcels of land
adjacent to and opposite such extension, in proportion to the
frontage of such lots and parcels of land abutting Iupon the street
where such extension is laid; provided, that the cost of con-
structing said extension at any street intersection or crossing
shall be wholly paid for by the city. All assessments for the
construction of said improvement shall be levied, assessed and
collected in accordance with the provisions of Ordinance No. 19,
1884.
Section 4. If any piece of real estate has already an
improvement conforming to the general plan of the improvement
herein authorized, or which the city council may find to be satis-
factory to it, an allowance may be made therefor to the owner, the
same to be deducted from his assessment and from the contract
price of said sewer extension.
Section 5. Said improvement shall be paid for in warrants
of the City of Fort Collins, which shall be payable out of the funds
collected on account of the assessments made for said improvement.
Said warrants shall be of such date, in such form, payable at such
times and in such denominations as may hereafter be prescribed
by the city council, and shall be executed, issued and disposed of
as the City Council may direct.
