OF GARBAGE DISTRICTS AND PROVIDING FOR THE CARE AND REMOVAL OF ALL GARBAGE WITH- IN THE CORPORATE LIMITS OF THE CITY OF FORT COLLINS BE IT ORDAINED BY ThE CITY COUNCIL OF THE CITY OF FORT COLLINS Section 1 It shall be unlawful for any person company or corporation to permit garbage to remain or accumulate on its or their premises within the corporate limits of the City of Fort Collins except the same be placed in cans and removed therefrom as hereinafter provided Section 2 That for the purpose of facilitating the removal and disposal of garbage ank securing proper sanitary conditions, and in the interest of public health, the City of Fort Collins is hereby divided into districts as follows, to-wit District No 1 shall comprise all that portion of the city fixed in the boundary of the fire limits District No 2 shall comprise all that portion of the city south of East Olive Street to Locust Street and east to Whedbee Street District No 3 shall comprise all that portion of the city south of Locust Street and east of Whedbee Street District No 4 shall comprise all that portion of the city south of Welt Olive Street to Laurel Street and west of College Avenue to South Grant Street District No 5 shall comprise all that portion of the city west of South Grant Street and south of West Mountain Avenue -1- District No 6 shall comprise all that portion of the city north of West Mountain Avenue to Laporte Avenue and west of North Mason Street to Shields Street District No 7 shall comprise all that portion of the city. !!__ north of Laporte Avenue and west of North Mason Street and i0ft of North Shields Street Section 3 Every owner or occupant of any house hotel restaurant, building, flat, apartment or tenement within the corporate limits of the City of Fort Collins where persons reside, board or lodge or where animal or vegetable food is prepared or served, shall provide for each house, hotel, restaurant, building flat, apartment or tenement, and at all, times maintain in a cleanly condition and in good order a vessel or vessels for garbage, for each flat, apartment or tenement building one such vessel for each floor of the flat, apartment or story of such building, or if such floor, flat or apartment be occupied by more than five persons, then one of such vessels for each additional five persons Each occupant tenant or person in charge of such house, hotel, restaurant building, flat, apartment or tenement, shall cause to be deposited in said vessel all garbage produced in or brought therein as soon as the same is produced or brought therein Such vessel for garbage shall be water-tight and be made of metal with a close-fitting cover and shall have a capacity of not more than fourteen (14) gallons The word "garbage" as used in this ordinance is hereby defined to mean and include any and all rejected or waste food, offal and carrion, and no person shall deposit in any such can or vessel anything -2- except garbage All such garbage deposited in cans in accor- dance with the provisions of this ordinance shall be removed by the City of Fort Collins without expense to the owners thereof, The owner shall cause said can to be placed adjacent to the alley or public highway so that the same will be readily accessible to the contractor charged with the duty of removing said garbage or the city wagons having charge of such work All persons having garbage under the provisions of this ordinance shall pro- vide the garbage can herein required Section 4 It shall bd the duty of the Health Officer Pure Food Commission and of the police to report to the Commissioner of Safety all persons and corporations failing and refusing to provide garbage cans within the requirements of this ordinance All persons, companies or corporations shall at all times com- ply strictly with the terms and provisions of this ordinance, and all such garbage cans shall at all times be under the inspectfbon and control of the Commissioner of Safety, the Health Officer and the police of the City of Fort Collins Section 5 Immediately upon the taking effect of this ordinance the City Council shall make provision for the removal of the garbage of the city beyond the corporate limits and may award the contract for the removal of said garbage to any person, company or corporation, who shall have the exclusive right to care for and remove all such garbage under the terms of a contract during the period for which the same is awarded No contract shall be made unless the person to -whom the same shall be awarded shall file a bond in the sum of Il._..�-� dollars, with sureties to be approved by the Commissioner of Safety conditioned for the full and faithful performance of the terms and provisions of the contract, which said contract shall require that -3- all garbage shall be removed in closed tanks and in compliance with the ordinances of the City of Fort Collins and the rules and regulations of the Board of Health in relation thereto It shall be the duty of the person who has a contract for the removal of garbage to remove the same daily, except Sunday, and from each garbage district as may be designated in the contract , and no person shall have the right to collect and remove garbage within the corporate limits of the City of Fort Collins except the duly authorized contractor for said work It shall be the duty of the person with whom the city contrka is for the removal of garbage to report all violations of the provisions of this ordinance to the Commissioner of Safety or the Chief of Police so that the terms and provisions of this ordinance may be enforced Section 6 Any person or persons violating any of the provisions of this ordinance shall be fined in a sum not less than five dollars ($5) no*ore than fifty dollars ($50) and the costs of the proceeding Section 7 Ordinance No 8, 1916, passed and adopted on the 27th day of March, 1916, and all ordinances and parts of ordinances in conflict with this ordinance are hereby repealed, but such repeal shall not in any manner affect any cause of action which may have accrued in favor of the Citv of Fort Collins under said ordinance or ordinances prior to the taking effect of said repeal, but the same shall be prosecuted as though no repeal had taken effect Introduced, read first time and ordered published at a regular meeting of the City Council City Council held, on the 7th day of May, A D 1917, was duly orddred by Aye and Nay vote to be published in the Fort Collins Courier, a daily newspaper of the City of Fort Collins, in accordance with the provisions of Section 7 of Article IV of the City Charter, that thereafter, and on, to-exit, the //ZiYY`day of May, 19173 at a regular meeting of the City Council, said ordinance came before said Council on its final passage, a period of more than ten days having elapsed since the publi- cation as above set forth, and that said ordinance as amended, was upon second reading adopted as an ordinance, and thereafter and on, to-Nit, the ZZXYLX XXKXXX4XXX91ZX day of May, 1917, said Ordinance No 1-:L1917, as finally passed and adopted, was duly published in the Fort Collins Courier a daily
