THE, CITY OF FORT COLLINS, COLORADO
WHIREAS, The City Council of the City of Fort
Collins, Colorado, has been petitioned to vacate all of the streets and
alleys lying in a tract bounded on the North by the South Line of East
Linden Street, on the West by the East Line of Third Street, on the
South by the North Line of East Lincoln Avenue, and on the East by the
East Line of Fifth Street, in Buckingham Place, an Addition to the
City of Fort Collins, Colorado, and
WHEREAS, It appears that said petition is
signed by the ovmer of all the property hereinbefore described, the
aforesaid property consisting of Blocks 5, 61 11 and 12, Buckingham
Place, adjacent to each other, and
Y&DIMAS, It appears that the streets and
alleys to be vacated have never been opened to the use of the public,
used by the public or the inhabitants of said City of Fort Collins,
Colorado, and it appearing that the said City of Fort Collins has
never expended any labor in connection with the maintenance of said
streets and/or alleys, and
YMEEAS, It further appears that the rights
of the inhabitants of the City of Fort Collins, Colorado, will in no
way be prejudiced or injured by the vacation of said streets and
alleys, now, therefore
BL IT ORDAINED BY THL CITY COUNCIL OF THE CITY OF FORT COLLINS
Section 1 That all of the streets and alleys
in Blocks 5, 61, 11 and 12, Buckingham Place, an Addition to the City
of Fort Collins, Colorado, being a tract bounded on the North by the

South line of East Linden Street, on the Test by the East Line of
Third Street, on the South by the North line of East Lincoln Avenue,
and on the East by the East line of Fifth Street, be and the same
we hereby vacated, and from henceforth the said streets and alleys
shall be treated as a part of the lots abutting upon the same and
all right, title and interest therein shall and hereby becomes
vested in the owner of the lots abutting upon said streets and
alleys, as provided by law.
Section 2 Anj and all e3p ense incurred
by the City of Fort Collins in and about these proceedings shall
be borne by the petitioner, seeking this vacation.
Section 3. In the opinion of the City
Council an emergency exists for the preservation of the public
health, peace and safety, and this ordinance shall take effect
upon its passage and publication, under and by virtue of the
authority contained in Sections 6 and 7 of Article IV of the
City Charter.
