BE IT ORDAINW BY THQ CITY COUNCIL OF TM, CITY OF FORT COLLINS:
Section 1. That Ordinance No. 7, 1921, being an ordinance relating to
loc94 public improvements and covering all forms of local public improvements,
assessments for the cost tbereof, and the issuance of bonds in payment of the
cost of the said improvements, axc3pt the construction of artificial lighting
@$stems, andproviding for the payment tlareof, be and the some is hereby
amended by adding thereto a section to be known as Section 3 3 to read as
follows.
"Section 33. It shall be lawP.:l for the City Council, on petition of
the owners of one-third of the frontage of real estate to be assessed, to order
the construction and appliances for the installation of a system of artificial
lighting, and regulate th3 use thereof and assess the cost thereof upon the
property within the limits of the artificial lighting districts created for
the purpose of constructing said lighting systems, in proportion to the
frontage of said lot or lots or lands within said lighting districts, or as
may be equitable and just, as may be determinsd by the City Council in ordoring
the installation of said lights and appliances after the creation of the
said district, provided that in cresting the said artificial lighting
districts the assessment and payment for the sacra, the sa:.d procedure shall
be observed as required in said Ordinance No. 7, 1921.
If the ownsre of one-third of the frontage of real estate to be
assessed shall petition for artificial lighting system and name soma kind of
substantial light pole units, be the sm-no --tal, concr3t3, tile or other
substantial light poles, then such improvement shall be ordered in accordance
light pole
with the petition, and the/units so designated stall be used, provided the
City Council shall deem such proposed improvements and the kind of light
poles good and sufficient for the particular locality, and uniform throughout
the entire district. If, however, the units so petitioned for are such that
they do not encourage competition, than it stall be the right of the
light pole
p3titioners to state in the petition the maximum price per/unit at which the
improvemant is desired, and no contract shall be let for any such improvet4tent
at a price sxcssd.ing the maxiTmm price fixed in, said petition, e3cluding the
cost o£ engineering, collection, insAecticn, wiring, incidentals and interest.
The selection of all materials and the detail work for the contraction
and installation of such artificial lighting system for any district so
created shall be within the discretion and under the direction of the City
Council, except as Tray be otherwise specified in the petition."
Section 2. In the opinion of the City Council an emergency alists
for the precarvation of th3 public health, peace and safety and this ordinance
shall take effect upon its passage- and publication, under and by virtue of
the authority contained in Sections 6 and 7 of Article IV of the City Charter.
Introduced, read at length and adopted by the unanim:us vote of all the

sections was duly proposed and read at length at a r3galar meeting of the City
Council held on the 13th day of March, A. D. 1926, and waa duly a dopted and
ordered published in the Fort Collins Express-Cmirier, a daily newspaper and
the official newspaper of the City of Fort Collins, by the unanimous vote of
all the r.embars of the City ^o -rcil; as an emergency ordinance in accordance
with the provisions of Sections 6 and 7 of Article IV of the Cit artsr; of
the City of Fort Collins, and thereafter and on to-wit: the day of
March, A. D. 1926, said Ordinance No. -- X! _ was duly published in the Fort
TLollin%AExpress-Co rier, a daily newspaper published in the City of Fort
Collins, Colorado.
