BEIAv j AN EMERGENCY ORDINANCE RELATIivG 10 THE ASSESSME9T OF
COST OF CONSTRUCTION OF IMPROVEMENTS IN CONSOLIDATED IMPROVEMEaT
DISTRICT NUMBER 5 OF THE CITY OF FOR`1 COLLINS AND PROVIDING FOR
THE PAYMENT AND COLLECTION THEREOF
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT COLLINS
Section 1 That unaer and by virtue of the provisions
of Ordinance No 15 of saia City of Fort Collins duly adopted
and approved on the 28th day of May 1917 Consolidated Improve-
ment District No 5 was duly created ana provision made in Baia
ordinance for the construction of certain improvements in said
District, consisting of concrete paving , curbing ana paving
with brick between the tracks ana two feet on each side thereof
of the Denver and Interurban Railroad Company' s tracks within
the limits of said district, that the said 1 nprovements as
therein provided have been duly constructed under contract as
provided oy law and duly acceptea by the City of Fort Collins
as therein provided, tnat tnereafter the City Engineer and the
Commissioner of Works on, to wit, the 25tn day of January 1919
duly reported to the City Council that the cost of +he
construction of said improvements, includi rg the cost of
inspection, collection and other inciaentals ana also includirg
interest to the first day of March 19193 wnen by the laws of
the State of Colorado the first installment of general taxes
is due and payable, (exclusive of the cost of paving the tracks
of the Denver and Interurban Railroad Company $9,422 33, and
one-half or the street intersections, 03,651 18) is $50,263 233
making; a total cost of inprovements in said district of $ 63,336 74,
that in and by said repor4- the Commissioner of Works pursuant to
report of the City Engineer, duly apportioned upon all of the
lots or tracts of land abutting upon the street improved in
proportion as the frontage of eacn lot or tract of lana is to
all the frontage of all the lots or tracts of land so improved
the siaes of corner lots abutting on streets or alleys so
improved being regarded as frontage to the extent of twenty-five
(25) feet, pursuant to the statute and the provisions of
Ordinance No 13, 1917 except as to the intersections of
streets ana alleys ana the share to be assessed against the
Denver and Interurban Railroad Conpany, which said assessment
was made in accordance with the provisions of Sections 5363,
5364 and 5366 of the Revisea Statutes of 1908, and which said
Consolidated Improvement District No 5 is hereinafter more
particularly described by lots ana blocks, together with the
apportionment ana rate per front foot, the saiu findings and
report of the Commissioner of Works being in accordance with
the report of the City Engineer in respect to the proposed
assessments on eacn lot in said district
Section 2 That at the regular meeting of the City
Council held on the 25th day oz January A D 1919 said report
of the Commissioner of works and Cicy Engineer concerning the
said proposed assessments for improvements in Consolidated
Improvement District No 5 was by resolution of the City Council
duly adopted for the purpose of consideration and determination
at an adjourned regular meeting of the City Council to be hela
at ten o' clock iu the forenoon on the 28th say of February, A D
1919, pursuant to a notice of the City Clerklas providea by law,
that in ana by saia resolution the City Cleric was instructed
and directea to puolish notice in the o=iicial newspaper of
the City oz Fort Collins for a period of ten days, addressea
to the ovners of the property to be assessed in Consolidated
Improvement District A0 5, stating the whole cost of the
improvement and the share apportioned to eacn lot or tract

of land in said aistrict, ana notifyirg the owners thereof
that any complaints or objectious that might be made in
writing by the-r to the City Clerk ana filed in his office
within thirty days from the publication of Baia notice would
be heara and determined by the City Cou roil at an adjourned
regular meeting thereof to be held on the 28th day of
February, A D 1919 at the hour of ten o' clock in the forenoon
of said day in the Council Chamber in the City Hall in said
city, that after saia hearing the Baia City Council would take
up the matter of the passage of an ordinance assessing the
cost of said improvements, that pursuant to the authority
contained in said resolution the City Clerk caused to be
published said notice in the Fort Collins Courier, the
official newspaper of said City of Fort Collins, ror a period
of ten days, as provided by law, and that due proof of said
publication has been duly filed in the office of the City
Clerk, that at said meeting of the City Council held on the
28th day of February , A D 1919 as aforesaid hearing was had
upon the writter objections and complaints theretofore filed
in the office of the City Clerk, and after consideration
further hearing and determination of saia objections and com-
plaints was postponed to an aajourfied regular meeting to be
held on the 6th day of March, 19190 at the hour of 4 30 P M
and at said adjourned regular meeting of the City Council hela
on the 6th day of March, 1919 at 4 30 o'clock P M a resolution
was duly adopted by the City Council sustaining saia written ob-
jections and complaints where the same showed clerical errors
in the schedule of assessments and as to all other written
objections and complaints the same were overruled and the
assessing ordinance for the cost of the improvements in said
Consoliaated Improvement District no 5 ordered submitted for

passage and adoption
Section 3 That the total cost of the improvements
in said Consoliaated Improvement District ivo 5 under and by
virtue of saia Ordinance go 15, 1917, of said city, including
the cost of inspection, collection and interest, to the first
dal of March 1919 amounts to $50,263 23 and the cost of the
paving of the tracks of the Denver and Interurban Railroad
Company $9,422 33 and one-half the cost of paving the street
intersections $3 651 180 sad the sum of $50,263 23 is hereby
assessed upon the real estate in said Consolidated Improvement
District Vo 5 in accordance with the provisions of Section
5363 of the Revised Statutes of 1908, and the 49,422 33 is
hereby assessed against the property of the Denver and Inter-
urban Railroad Company in said district pursuant to the
authority contained in Section 5362 of the Revised Statutes
of 1908 and also pursuant to the authority contained in
Section 5 of Ordinance ivo 15, 1917 , creating said Improvement
District ana the $3, 651 18 is hereby assessed against the
City of Fort Collins in pursuance of the authority contained
in Section 5366 of the Revised Statutes of 1908 and also
pursuantito the authority contained in Section 11 of Ordinance
No 15 , 1917 creating said Inprovement District, and the
prcportioii of said cost assessed to eacn lot or tract of land
in said consolidated Irprovement District iao 5, couprising
the following lots and blocks in saia aistrict , shall be as
follows, to wit

Section 4 The assessments herein provided for shall
be aue and payable witnin thirty days from the final passage
and publication of this ordinance, without demana, provided
that all assessments may at the electioni of the owners of the
property assessed be paid in twenty (20) annual installments,
beginning April let , 1919, and payable annually on Baia last
mentioned date thereafter until the full account thereof has
been paid, with interest on the unpaia principal payable semi-
annually at the rate of five per cent per annum
Section 5 Failure to pay the whole of the assessments
within the said period of thirty days shall be conclusively
considered and hela an election on the part of all persors
interested, whether under disability or otnerwise, to pay in
such installments
Section 6 Failure to pay any installment, whether
of principal or interest, when due, shall cause the whole of
the unpaid principal to become due and payable immediately.,
and the whole amount of the unpaid principal and accrued interest
shall thereafter draw interest at the rate of one (1) per cent
per month, or fraction of a month, until the day of sale as
hereinafter provided, but at any time prior to the day of sale
the owner may pay the amount of all unpaid installments , with
interest at one (1) per cent per diontn, or fraction of month,
and all penalties accrued, ana shall thereupon be restorea to
the right to pay the installments in the same manner as if
default had not been suffered The owner of any property not
in default as to any installments or payments may at any time
pay the whole of the unpaia principal , with the interest
accrued to the maturity of the next installment of interest or
principal

Section 7 Payments may be made to the City Treasurer
at any time within thirty days of the final passage ana publica-
tion of this orainance aia an allowance of five (5) per cent
discount shall be made on all payments made curing such period
only
Section 8 In case of default in the payment of any
installment of principal ana interest when due, any and all
property concerning which such default is suffered shall be
advertised by th.a County Treasurer aria sold for the payment
of the whole of the unpaid assessment tnereon at the same time
or times ana in the same mariner, under all the same conditions
and penalties and with the same effects as are proviaed by law
for sales of real estate in default of the payment of general
taxes
Section 9 It shall be the duty of the City Clerk
to prepare the foregoing assessment roll in said Consolidated
Improvement District No. 5 in proper form, showing in suitable
columns each piece of real estate assessed, the total amount
of the assessment, the amount of each installment of principal
and interest, and the date wnen eacn installment will become
due, with suitable columns for use in case of payment of the
whole amount or of any installment or penalty, and aeliver the
same to the City Treasurer, ana thereafter payments may be
made to the C3.ty Treasurer at any time witnin thirty days
after the passage of this assessing ordinance Upon the
expiration of the thirty days the City Treasurer shall return
to the City ClerK the assessment roll showing all payments
made thereon, with the aate of eacn payment, and thereupon
the City Clerk shall prepare a permanent local assessment roll

estate or property upon which the assessment is unpaia, the
whole amount of the assessment unpaia, the date to which the
same was conputed, and the amcuiLt of eacn installment of
principal and interest ana the date when the same will
become due, witn suitable columns for use in case of the
payment of any installments or penalties Said roll shall
be certified by the City Clerk, unaer the seal of the city,
and by him delivered to the County Treasurer of Larimer
County with his warrant for the collection or the same
Section 10 All collections nade by the County Treasurer
on said assessment roll in any calendar aiontn shall be accountea
for ana paid over to the City Treasurer on or before the tenth
say of the next succeeding calendar month, with separate state-
ments for all such collections for eacn month
Section 11 The owner of any aivided or unaiviaea
interest may pay his share of any assessment upon producing
evidence of the extent of his interest satisfactory to the
officers have rg the roll it charge
Section 13 In the opinion of the City Council an
emergency exists for the preservation of the puolic health ,
peace aua safety, ana this ordinance shall take effect upon
its passage and publication under ana by virtue of the
authority contained in Sections 6 and 7 of Article I4 of the
City Charter

the Council, as an emergency ordinance, in accordance with
the provisions of Sections 6 and 7 of Article IV of the City
