ORDINANCE NO 1919
BEING AN EMERGENCY ORDINANCE RELATING TO THE ORGANIZATION
AND ADMINISTRATION OF A DEPARTMENT OF CITY GOVERNMENT UNDER
THE SUPERVISION AND CONTROL OF THE COMMISSIONER OF HIGHWAYS
PUBLIC WORKS AND UTILITIES WHICH SAID DEPARTMENT SHALL BE
KNOWN AS THE " hUNICIPAL RAILWAY DEPARTMENT "
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT COLLINS
Section 1 The City of Fort Collins having acquired
by purchase the railway property of The Denver and Interurban
Railroad Company situated in the City of Fort Collins and
connected therewith under and by virtue of Section $1 of

Article XVIII of the City Charter , and pursuant to authority
granted by a vote of the qualified electors of the City of
Fort Collins at a special election held on the seventh day
of January, 1919s for the purpose of operating a street
railway system there is hereby organized and created a
department of city government to be known as the "Municipal
Railway Department " to be organized and administered by the
City Council in the immediate charge and control of the
Commissioner of Highways, Public Works and Utilities, under
the terms and provisions of this ordinance and pursuant to
✓ the authority contained in Section 3 of Article V of the
City Charter and such ordinance or ordinances, rules and
regulations as may be hereafter adopted by the City Council
concerning the organization, administration and operation
of the municipal railway system now owned and to be operated
by the City of Fort Collins
Section 3 The officers charged with the operation
and administration of said municipal railway shall be as
follows The Commissioner of Works, who shall have the general
supervision and control of said municipal railway department ,
a Superintendent, who shall be charged with the duty of
directly operating said municipal railway, controlled and
directed in his work by the Comiissioner of Corks ana such
other subordinate employees to be appointed by the Commis-
sioner of Corks, subject to the approval of the City Council
as may be necessary for the proper operation of the cars on
said municipal railway, car barns and electrical apparatus
operated therein furnishing power for driving cars, and the
maintenance and upkeep of the tracks and wire lines of said
municipal railway, also a City Municipal Railway Physician,
whose duties shall be principally to look after employees
or passengers who may be ill or suffer an injury by reason
of any accident in the operation of said municipal railway
and an Auditor, whose duties shall be to receive and audit
all collections made by motormen in the operation of said
municipal railway, as well as all bills incurred in operating
the same , and to provide and keep a set of cocks in accordance
with the system prescribed and required by the Public Utilities
Commission of the State of Colorado, in order to show full and
complete accounting of the operating revenues and operating
costs of said municipal railway, subject to the authority
contained in this ordinance and such rules and regulations
' as gray hereafter be promulgated by the (commissioner of Corks
and approved by the ulty Council, which said rules and
regulations when duly approved by the City Council and duly
printed and posted in the City Hall, in the care , and at all
public places on said municipal railway, shall have the force
and effect of an ordinance and subject to the same penalties
as provided in this ordinance in the event of conviction for
violation of any of said rules and regulations, the same as
though incorporated within the provisions of this ordinance
The Commissioner of Finance and Ex-officio City Treasurer
shall be Treasurer of all revenues and receipts under the
municipal railway system and the Auditor of the municipal
railway is hereby authorized and required to pay over to the
City Treasurer all receipts within twenty-four hours after
the same are received, taking the Treasurer' s receipt therefor
Section 3 The Commissioner of works, in cooperation
with the Superintendent of said Municipal Railway, is hereby
authorized and empowered to prescribe and have printed the
necessary forms for application for employment, also accidert
reports for passengers or employees injured and special
accident reports for stock, together with forms for damage
cases and accident cards for witnesses to sign, and a form-"
of release for employees to sign in case of accident to
themselves , before returning to duty
Section 4 There shall be no free transportation over
the municipal railway lines except such as may be prescribed
by the rules and regulations issued by the Commissioner of
Works and approved by the City Council
Section 5 The salaries of the officers and employes
of the Municipal Railway shall be fixed from time to time by
the Commissioner of works and approved by the City Council
Section 6 Any person or corporation violating any
of the provisions of this ordinance or any of the rules and
regulations adopted by the City Council respecting the
management and operation of the Municipal Railway shall
upon conviction be fined in any sum not less than five (5)
dollars or more than one hundred (100) dollars and the costs
of the proceedings
Section 7 In the opinion of the City Council an
emergency exists for the preservation of the public health

peace and safety, and this Ordinance shall take effect upon
its passage and publication under and by virtue of the
authority contained in Sections 6 and 7 of ArticleIV of the
City Charter
Introduced, read at length and adopted by the
unanimous vote of all the members of the City Council this
fifth day of April A D 1919

the foregoing ordinance consisting of seven (7) sections
was duly proposed and read at length at a meeting of the
City Council held on the fifth day of April, A D 19193
and was duly adapted and ordered published in The Fort
Collins Courier, a daily newspaper and the official paper
of the City of Fort Collins, by the unanimous vote of all
the members of the Council as an emergency ordinance, in
accordance with the provisions of Sections 6 and 7 of
Article IV of the City Charter, and thereafter and on

Colorado, and the official newspaper designated for such
