BEING AN EMERGENCY ORDINANCE, RELATING TO WILD BIRDS AND CREATING
A BIRD SANCTUARY
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT COLLINS
Section 1 That the area within the corporate limits
of the City of Fort Collins as the same now exists , or may at any
time hereafter be extended, is hereby made and constituted a bird
sanctuary for the refuge of wild birds , and all persons are urged
to protect the wild birds and encourage their propagation and
refuge within such sanctuary
Section 2 It shall be unlawful for any person at
any time within the corporate limits of the City of Fort Collins ,
to frighten, shoot at, wound, kill, capture, ensnare, net, trap,
or in any other manner molest or injure any robin, thrush, lark,
whippoorwill, finch, wren, marten, swallow, snowbird, bobolink,
blackbird, crow, raven, oriole, kingbird, mockingbird, quail, or
any song or insectivorous bird, or in any manner molest or injure
the nests, eggs, or young of any such birds Provided that this
section shall not be construed to apply to English or European
house sparrows , and provided further that the Commissioner of Safety
and Ex-Officio Mayor shall have authority to grant permit for the
killing or capture of pigeons or other birds when it is shown that
the same are or have become a nuisance in any particular locality
Section 3 Any persons violating the provisions of
Section two of this ordinance, shall be deemed guilty of a misde-
meanor, and upon conviction thereof shall be fined in a sum not less
than one dollar, and not more than ten dollars , or imprisoned in
tqe County Jail not more than tnirty days
Section 4 In the opinion of the City Council an
emergency exists for the preservation of the public health, peace

and safety, and this ordinance shall take effect upon its passage
and publication, under and by virtue of the authority contained
in Sections 6 and 7 of Article IV of the City Charter
Introduced, read at length, and adopted by the unanimous
vote of all members of the City Council, this 13th day of December,

of four (4) sections , was duly proposed and read at length at a
regular meeting of the City Council held on the 13th day of December,
A D 1924, and was duly adopted and ordered published in the Fort
Collins Express-Courier, a daily newspaper and the official newspaper
of the City of Fort Collins , by the unanimous vote of all members
of the Council, as an emergency ordinance, in accordance with the
provisions of Sections 6 and 7 of Artie IV of the City Charter,
and thereafter, on to-wit the /d ^ day of December, A D 1924,
said Ordinance No a 9 was duly published in the Fort Collins
Express-Courier, a daily newspaper published in the City of Fort
Collins , Colorado
