HomeMy WebLinkAbout029 - 12/13/1924 - RELATING TO THE REMOVAL OF WEEDS, BRUSH, AND RUBBISH FROM LOTS AND TRACTS OF LAND, FROM THE ALLEYS I 1 ORDINANCE NO 1924, BEING AN EMERGENCY ORDINANCE RELATING TO THE REMOVAL OF WEEDS , BRUSH, AND RUBBISH FROM LOTS AND TRACTS OF LAND, FROM THE ALLEYS IN THE REAR AND FROM SIDEWALK AREAS IN FRONT THEREOF AND PROVIDING FOR THE PAYMENT AND COLLECTION OF THE COSTS OF REMOVAL BE IT ORDAINED BY THE CITlY COUNCIL OF THE CITY OF FORT COLLINS Section 1 That all weeds on private property and all brush and rubbish on said property, and on the alleys in the rear and the sidewalk and parking areas in front thereof within the City of Fort Collins, are hereby declared to be a nuisance and a menace to the health and safety of the inhabitants of the City of Fort Collins , and every person, firm or corporation owning real property within the corporate limits of the City of Fort Collins, or his , their, or its agents , are hereby required to cut and remove all weeds from the property owned by such person, firm or corporation, and upon the side- walk and parking area in front of such real estate and the alley in the rear thereof and to remove all brush and rubbish therefrom and keep and maintain said property and alley, sidewalk and parking areas free from weeds brush or rubbish and the Commissioner of Public Works is hereby authorized and directed to give notice to any property owner, or nis , their or its agents, if known, whose property is being kept or maintained contrary to this ordinance, and such notice may be by mail deposited in the Post Office at Fort Collins , Colorado, addressed to the record owner or owners, or agent, if known, that if the weeds, brush and rubbish are not removed from such premises on or before ten (10) days from the date of such notice (or on or before three (3) days , if the premises are within the fire limits ) the same will be done by the City of Fort Collins and the cost thereof, including cost of inspection and other incidental costs in connection therewith will be assessed against the said real property, and if the weeds shall not be cut and removed, and brush and rubbish removed, within ten (10) days #V (or three (3) days , as the case may be) from the date of said notice, the same may be done by the City of Fort Collins , by the Department of Public Works , and the cost thereof, including inspection and other incidental costs in connection therewith shall be assessed against the lot or lots or tracts of land from or abutting upon which said -?k&W,FI ie(WMa weeds , brush and rubbish are removed,4 pursuant to the provisions of Ordinance No 19, 1884 respecting special assessments Section 2 The cost of the removal of weeds , brush and rubbish of all kinds from any lot or lots or tracts of land or from the alley behind and from the sidewalk and parking area in the street in front, of any such lot or lots or tracts of land within the cor- porate limits of the City of Fort Collins , shall be assessed upon the lot or lots /or tracts of and from which said weeds , brush and rubbish Q++l�- Ae ouriiihq are removed,fin accordance with the provisions of Ordinance No 19, 1884, "Concerning assessment and collection of Special Charges" , and such assessment shall be a lien in the several amounts assessed against each lot or tract of land until paid, and shall have priority over all other liens except general taxes and prior special assessments In case any such assessment is not paid within thirty (30) days after the same has been certified to the City Clerk by the Commissioner of Public Works, the City Clerk shall then be and is hereby authorized to certify to the County Treasurer of the County of Larimer the list of all de- linquent assessments , giving the name of the owner as appears of record, the number of the lot and block, and the amount of assessment, said certification to be the same in substance and in the same form as re- quired for the certification of sewer ta,ces , and the County Treasurer, upon the receipt of such certified list is hereby authorized to place the same upon the tax list for the current year and to collect the special assessment in the same manner as other taxes are collected with y M ten per cent penalty thereon, and all the laws of the state for the assessment and collection of the general taxes, including the laws for the sale of propertv for taxes and the redemption thereof, shall apply to and have full force and effect for the collection of all such assessments Section 3 Ordinance No 11, 1914, being an ordinance relating to the removal of weeds , brush and rubbish, and all ordinances or parts of ordinances in conflict with this ordinance are hereby repealed, but this repeal shall in no wise affect any penalty or cause of action whicn may be accrued in favor of the City of Fort Collins or any assessments that may be in process of collection, under said repealed ordinances prior to the taking effect of this ordinance Section 4 In the opinion of the City Council an emergency exists for the preservation of the public health, peace and safety and this ordinance shall take effect upon its passage and publication under and by virtue of the authority contained in Sections 6 and 7 of Article IV of the City Charter Introduced, read at length and adopted by the unanimous vote of Council, as an emergency ordinance, in accordance with the provisions of Sections 6 and 7 of Article IV of the City Charter and thereafter and on to-wit the day of December, A D 1924, said Ordinance
