BEING AN EMERGENCY ORDINANCE CONCERNING THE PRESERVATION OF THE
PUBLIC HEALTH AND SAFETY AND ABATEMENT OF NUISANCES
BE IT ORDAINED B`r THE CITY COUNCIL OF THE CITY OF FORT COLLINS
Section 1 If it shall be made to appear to the
Commissioner of Safety and Health and Ex-Officio Mayor of the
City of Fort Collins, that any premises within said City are
in an insanitary or dangerous condition, or that the same are
filthy, offensive or are dangerous to the life or property of
persons or may cause an unnecessary fire hazard, he shall
forthwith cause notice of such condition to be given to the
owner, agent or occupant of said property and order said
premises to be put in proper condition within such period
thereafter as he may deem necessary, however, not less than
twenty-four (24) hours
If the owner, agent or occupant
of said premises shall fail or refuse to comply with the order
of said Commissioner of Safety and Health and Ex-Officio Mayor
within the time given therein, then the matter of said failure
or refusal to comply with said order, shall be heard before the
next meeting of the City Council of the City of Fort Collins,
without further notice to the owner, agent or occupant of said
premises, and at said meeting said owner, agent or occupant
of said premises or any other person interested, may appear and
be heard
After said hearing the said City
Council shall make such order concerning remedying the con-
dition complained of as may be deemed necessary and may declare
the said premises to be a nuisance, 'Iand cause the same to be

remedied, repaired or abated, and shall assess the expense of
so doing against the lot or premises upon which said condition
or nuisance may be found as provided by law
Section 2 Nothing herein shall be deemed to
limit the power of the Commissioner of Safety and Health and
Ex-Officio Mayor in case of an emergency for the preservation
of the public health or safety, to summarily remedy, change,
repair or abate any dangerous or unhealthy condition found to
exist,,Jwithout any notice to any person whatsoever
Section 3 In case the said lot or premises
are not occupied and the owner thereof is not found within
the City of Fort Collins when the said notice is about to be
given, said City Council may have said premises cleaned,
changed, repaired or the nuisance abated without serving
personal notice of any kind upon the owner or agent thereof,
and may assess the costs thereof against said lot or premises
Section 4 Any person ordered to clean,
repair, change or make safe any property or abate any nuisance,
may do so at his own expense, if suitable arrangements therefor
are made with the Commissioner of Safety and Health and Ex-
Officio Mayor, prior to the time when the said City shall
start carrying out any order made under this ordinance
Section 5 Anyone violating any of the
provisions of this ordinance shall, upon conviction thereof,
be fined in a sum not less than $5 00 nor more than $300 00
and costs of suit , and in default of payment thereof, shall
be committed to jail until such fine and costs are paid
Section 6 In the opinion of the City
Council an emergency exists for the preservation of the
public health, peace and safety, and this ordinance shall

take effect upon its passage and publication, under and
by virtue of the authority contained in Sections 6 and 7
of Article IV of the City Charter
Introduced, read at length and adopted
by the unanimous vote of all the members of the City Council
at a regular meeting held this 12th day of September, A D
1930

I, A J ROSEUOW, City Clerk of the
City of Fort Collins, do hereby certify and declare that the
foregoing Ordinance, consisting of six (6) sections, was duly
proposed and read at length at a regular meeting of the City
Council held on the 12th day of September, A D 1930, and
was duly adopted and ordered published in the Fort Collins
Express-Courier, a daily newspaper and the official newspaper
of the City of Fort Collins, by the unanimous vote of all
members of the Council, as an emergency ordinance, in accordance
with the provisions of Sections 6 and 7 of Article IV of the
City Charter, and thereafter and on to-wit the 16th day of
September, A D 1930, said Ordinance No 13 was duly pub-
lished in the Fort Collins Express-Courier, a daily newspaper
published in the City of Fort Collins, Colorado
