BEING AN EMERGENCY ORDINANCE CONCERNING LOST, STOLEN
OR CONFISCATED PERSONAL PROPERTY IN THE POSSESSION OF THE POLICE
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT COLLINS
Section 1 All lost property found, stolen property
seized and remaining unclaimed and all property confiscated
according to law and not otherwise disposed of, remaining in the
possession of the police of the City of Fort Collins shall,
immediately upon taking, be delivered to the chief of police,
as custodian thereof, who shall keep a record of all such
property together with the date when and the place from which
the same was taken, which shall be a permanent record open to
the inspection of the public
Section 2 Any property seized or taken possession
of as aforesaid which shall not be claimed by and possession
surrendered to the rightful owner thereof shall be subject to
sale at the regular semi-annual public auction of such property
once
in the manner r following The chief of police shall publish/in
a newspaper in the City of Fort Collins, a description of each
and all articles of property so seized or taken, which have been
in possession of the police for more than six months and give
notice that if such property be not claimed by the rightful
owner or owners within ten days from the last date of said
publication, such property will be sold at such public auction
at; the place and in the manner as in said notice prescribed
If within ten days from the publication of slid notice,
no claim for such property described in the notice shall have

been made and determined by the rightful owner thereof,
the chief of police shall proceed to sell such property at
public auction in the manner and upon the terms named in said
notice The chief of police may adjourn such auction from time
to time not exceeding 30 days by giving oral or posted notice
of such continuance at the time and place advertised for the
holding of said auction sale The proceeds of any sale or
sales so made, after deducting therefrom the cost of storage,
advertising and selling, etc , shall be paid to the City Clerk
to be placed into the general fund of the City of Fort Collins
Section 3 Provided, however that if any
property seized or taken possession of by the police as afore-
said shall be of a perishable nature or of such nature as to
make it inadvisable, in the opinion of the chief of police,
to retain possession thereof for the length of time hereinabove
specified, he may, with the written consent of the Commissioner
of Safety and Health and Ex-Officio Mayor, cause such property
to be forthwith advertised for sale at auction, stating in his
notice therefor its perishable nature or reason for the immediate
sale thereof and the time and place of such sale and in not less
than three days after such advertisement, he may proceed to sell
such property at public auction Provided further that nothing
In this section contained shall refer to any impounded animals
as may be provided for in any city ordinance
Section 4 That from and after the sale of such
personal property, as aforesaid, the owner or person entitled
to same shall be forever barred from any and all claim of right
to said property, or to the proceeds thereof
Section 5 In the opinion of the City Council
an emergency exists for the preservation of the public health,
peace and safety, and this ordinance shall take effect upon

its passage and publication, under and by virtue of the
authority contgined in Sections 6 and 7 of Article IV of
the City Charter
Introduced, read at length and adopted by
the unanimous vote of all the members of the City Council at
a regular meeting, held this 19th day of September, A D 1930

I, A J ROSENOW, City Clerk of the City
of Fort Collins, do hereby certify and declare that the fore-
going ordinance, consisting of five (5) sections was duly
proposed and read at length at a regular meeting of the City
Council held on the 19th day of September, A D 1930, and
was duly adopted and ordered published in the Fort Collins
Express-Courier, a daily newspaper and the official newspaper
of the City of Fort Collins, by the unanimous vote of all
members of the Council, as an emergency ordinance, in accordance
with the provisions of Sections 6 and 7 of Article IV of the
City Charter, and thereafter and on to-wit the 23rd day of
September, A D 1930, said Ordinance No 14_ was duly pub-
lished in the Fort Collins Express-Courier, a daily newspaper
published in the City of Fort Collins, Colorado
IN WITNESS WHEREOF, I have hereunto set
my hand and affixed the seal of said City, this 23rdday of
September, A D 1930
